***BY REGISTERING FOR THIS AUCTION, YOU AGREE TO THE FOLLOWING TERMS***
1) Property Information & Inspection: All descriptions are believed to be accurate, but are not guaranteed. Items have not been authenticated. Please inspect pictures and ask questions (765-744-4526) prior to bidding and prior to the preview. All items are sold "AS IS-WHERE IS." Every bidder agrees that his/her decision to bid on an item and the amount that he/she bids are based solely on the bidder's inspection/evaluation of the auction item. Please come to the PREVIEW to inspect items before bidding. If you choose to not attend the PREVIEW, you forfeit any opportunity for dispute based on condition, completeness or satisfaction with your purchase.
1A) SLIDING SCALE Buyer's Premium:
15% on INVOICES totaling <$1,497.50
8% on INVOICES totaling >$1,500 but <$19,997.50
5% on INVOICES totaling <$20,000
2) Credit cards for purchases are run immediately following the auction close.
3) Credit cards with insufficient funds must be paid within 24 hours of the auction close. Invoices that are not paid within 24 hours are subject to the auctioneer's discretion.
4) Only our established buyers may make cash arrangements. New buyers will need to pay via credit card until credibility has been established.
5) It is your responsibility to know the pickup day and times.
6) ANY arrangements made for later pickup need to be made prior to the auction closing. There is a $10/lot pickup fee. Items will be held 7 days.
7) Shipping of small (<12") items may be available. There is a $10/lot handling fee in addition to the cost of postage. Please let us know in advance, if you intend to buy something that needs shipped. We have the right to refuse shipping large items or multiple breakable items. Thank you!

9) Bidding Increments: Shirey Farms Auction Services reserves the right to determine bid increments.
10) Auction End Time: Our auctions have an auto-extend or soft close which may allow certain items to go beyond the specified end time. These extensions are based on bid activity at the time of close. Items close in numerical order.
11) Outbid Notification: Bidders will be notified via email when they have been outbid. Please note that email notifications may be delayed due to internet connections/speed and the bidder is responsible for tracking their bids. By clicking the refresh button on specific lots or placing your max bid, you will be current on auction activity.
12) Shirey Farms Auction Services has full discretion to modify date and time, sale order or description of any auction item. We reserve the right to reject any bid at our sole discretion.
13) Server & Software Issues: In the event that there are technical difficulties related to the server, software or any other online auction-related technologies, Shirey Farms Auction Services reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the company providing the software or Shirey Farms Auction Services shall be held responsible for a missed bid or the failure of the software to function properly for any reason. Email notifications may be sent to registered bidders with updated information as deemed necessary by Shirey Farms Auction Services.
14) Buyer assumes responsibility and risk of loss or damage at the time the item is declared sold. Buyers are responsible for making sure that all items purchased are accounted for before leaving the designated pickup location. Please bring your invoice to track items as they are picked up.
15) Items that are not picked up during the specified times, will be forfeited and become the property of the auction company. If other arrangements are needed, contact Marla (765)744-4526 PRIOR to BIDDING.
16) Buyer's premium of 15% will be added to the final bid price to determine final selling price.
17) Payment: All sales are final. There are no returns, refunds or adjustments. Credit card payment accepted. (VISA, DISCOVER, MASTERCARD AND AMERICAN EXPRESS)
18) Bidders must present a copy of their paid invoice at pickup. Bidders are responsible for packing, loading and transporting their items without assistance from the auction company.
19) Security: Surveillance and security are on site; please do not enter the property except at the specified preview date and time of pickup.
20) Limitation of Liability: If, for any reason, the auction company is unable to deliver a purchase, the sole liability of the auction company shall be to return any paid monies in respect to that purchase.
21) By bidding on any item, the buyer agrees to all terms and conditions set forth.
22) This auction permits bids to be placed by the auctioneer, employee of the auctioneer, the seller, family member or associate of the seller or an agent on the seller's behalf.

This auction includes Row Crop Tillage and Harvesting Equipment, Hay and Forage Equipment along with Grain Handling/Hauling Equipment. There are several unique items that have been tucked in the barn for several years! The barns are full and some of these items have been parked outside and subject to the weather.
