Real Estate Auction Terms & Conditions:
Bids may be placed by calling our office at (812) 254-2220, calling Mark at (812) 486-8927, NOTE: Final bid is subject to owner's approval. DOWN PAYMENT: A down payment of $5,000.00 will be required on the day of the auction. The down payment (earnest money) may be made in the form of Check or Certified Cashier's Check, is non-refundable and will be applied to the purchase price at closing. BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing if needed. A pre-approval letter from your lender may be required to bid. ACCEPTANCE OF BID PRICES: The successful bidder will be required to sign a Purchase Agreement upon acceptance of the final bid. (The final bid is subject to the Sellers acceptance or rejection). AS-IS: The property is being offered As-Is, without any contingencies. EVIDENCE OF TITLE: Seller shall provide an Owner's Title Insurance Policy in the amount of the purchase price. DEED: Seller shall provide Warranty Deed(s). SURVEY: The cost for the survey will be split 50/50 between the buyer & seller. CLOSING: The balance of the purchase price is due at closing, which will take place in 45 days after the auction, or as soon thereafter as applicable closing documents are completed by the Seller. Fees for an administered closing shall be shared 50/50 between Buyer(s) and Seller(s). POSSESSION: Possession will be given 60 days after closing. REAL ESTATE TAXES: Real Estate taxes shall be prorated to the date of closing. PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries, and due diligence concerning the property. The Seller disclaims any and all responsibility for Bidders safety during any physical inspection of the property. SURVEY: The cost of the survey, if needed, will be the responsibility of the buyer. DISCLAIMER AND ABSENCE OF WARRANTIES: The property is being sold on an AS IS, WHERE IS basis, and no warranty expressed or implied, concerning the property is made by the Seller or the Auction Company. All sketches in the brochure are approximate. Each potential bidder is responsible for conducting his or her own independent inspections, investigations, and inquiries concerning the property. The conduct of the auction and increments of bidding are in the direction of the Auctioneer.
