REGISTRATION TERMS: Online Bidder registration required. Barnard Auctions does not register bidders. We utilize a professional rented online bidding platform and do not control registrations. Everything SOLD AS-IS, WHERE-IS, with no warranty or guarantee expressed or implied.
This is an Online Only Auction - All Bidders registering for this auction are required to be approved by Barnard Auctions before any bids can be placed - in order to prevent an unqualified bidder from placing bids (Example: an underage person, or a person with a fraudulent bidding account). If a bidder is an existing customer, and known by the auctioneer, they will be quickly approved after online registration. All Bidders must provide name, physical mailing address, email address, telephone numbers, and credit card information for further verification. This Auction has an Extended Bidding or "Soft Close" feature. The auction begins closing at 6 PM (CST) . The first item will begin to close, and an item will close every 60 seconds after. When a bid is submitted during the Final Seconds of the Auction for a Lot, the Bidding for that Lot will be Extended for an Additional Two Minutes. This will continue until there are no longer any bids Submitted for that Individual Lot. PAYMENT TERMS: Winning Bidder (s) required to enter into a written purchase contract the next day of online bidding closing or by next business day, as directed by the Seller's Attorney - Jay Fyie of Fyie & Rice. A 10% (Ten Percent) down payment to be placed in escrow (without interest) with the balance due on or before 45 days from auction date. A 3% buyer's premium will be added to the bid price to establish a total contract price, plus applicable closing costs. Cash, check or approved payment for the down payment amount is to be placed in escrow upon signing of the written contact to purchase said real estate. Possession after closing, and after Tuesday April 1st, 2025. BUYER'S PREMIUM: A 3% buyer's premium will be added to the purchase. Example: If you bid $100,000.00, you will be charged $103,000.00 in the purchase contract. All tracts must sell through the auction on-line process, no presales. There will not be live/in-person bidding. You may place an absentee bid, please call 1-800-840-SOLD (7653) to make arrangements. Absentee bid (s) must be presented 24 hours before closing of auction. Everything SOLD AS-IS, WHERE-IS, with no warranty or guarantee expressed or implied. Announcements made date of auction take precedence over all previous advertisements. Real Estate Offered Subject to Seller's Confirmation. Motivated Sellers! High bidder (s) will receive an email invoice confirmation and phone call upon auction closing. Seller: Breeze Investments LLC, dba Breeze Family Tire Center POSSESSION AT CLOSING: Real Estate Taxes: Real Estate Taxes pro-rated at date of closing. Seller at closing will convey good and marketable title. Buyer and Seller responsible for customary closing costs issued by the title company. SERVER & SOFTWARE TECHNICAL ISSUES: In the event there are technical difficulties related to the server, software, or any other online auction related technologies, Barnard Auctions reserves the right to extend bidding, continue the bidding or close the bidding. Neither the company providing the software, nor Barnard Auctions shall be held responsible for a missed bid or the failure of the software to function properlty for any reason. Email notifications will be sent to registered bidders with updated information as deemed necessary by Barnard Auctions. The Auctioneer reserves the right to cancel, suspend, extend, or reschedule an individual item and or auction event or make changes to the auction closing times or inspection or removal times. Each Potential bidder is responsible for conducting his or her own independent inspection, & inquiries. All information is presented in good faith but the auctioneer or seller does not warrant or present that the information provided is complete or accurate. All inspections, due diligence, and determinations are the sole responsibility for the buyers. This property is offered at auction with No buyer contingencies.
