This Website is offered and available to users who are 18 years of age or older. By using this Website, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Website thereafter.

All products offered for sale and/or auction through the Website ("products") is made available by third-party sellers ("sellers") on an "AS IS" basis without any representations or warranties by us or the seller and no statement anywhere, whether oral or written, whether made on the Website or elsewhere, shall be deemed such a warranty, representation or assumption of liability. We make no representation and warranties, express or implied, as to whether the purchaser acquires any copyrights, trademarks or other intellectual property.
You should inspect each product before bidding to determine the condition, and confirm the specifications, of such product.
Withdrawal.
We reserve the right to withdraw any product before the sale and shall have no liability whatsoever for such withdrawal.
Bidding
You must honor all successful bids placed in any auction. In the event you complete a successful bid, you will be obligated to pay the full amount of the successful bid and shall complete the transaction with the Company or the respective seller. A "successful bid" is defined as the highest bid in a regular auction (one with no reserve price) or the highest bid in a reserve auction that meets or exceeds the reserve price. By bidding in an auction you agree to honor all listed terms of sale including, but not limited to, method of payment, appropriate state sales tax, and shipping and handling fees.
You are required to provide accurate and complete personal information on your registration and you hereby further agree that whether you are acting as a principal, an agent, or an officer or director of a corporation, or otherwise in any capacity whatsoever, you are personally liable for the payment of the purchase price, buyer's premium and taxes payable with respect to any product auction which you are the successful bidder
By bidding on a product you represent and warrant that any bids placed by you are not the product of any collusive or other anti-competitive agreement and are otherwise consistent with federal and state antitrust law.
We reserve the right to reject any bid, in our sole discretion.
Final Sale
All purchases through the Website or as a result of visits made by you are governed by these Terms of Use.
ALL PURCHASES MUST BE PAID IN FULL WITHIN 48 HOURS OF RECEIPT OF INVOICE. Invoices will be e-mailed within 24 hours of auction closing. All sales are subject to sales tax, unless buyer provides Company with a valid tax exempt form. Payment shall be made by cash, electronic funds transfer, cashiers check or a personal or company check accompanied by a bank letter of credit.
Title to a product will not pass until we receive full payment in the form described above. In addition to other remedies available to us by law, in the event payment is not made in full within 48 hours of receipt of invoice, we reserve the right (i) to impose interest on the amount due from the date of sale equal to 18% percent per annum, or the highest rate permissible by law, whichever shall be less, and/or (ii) treat the purchased product as property of the bidder and hold possession and/or resell such product without notice and use the sale proceeds therefrom to recover any loss or cost incurred due to bidder's failure to pay.
Rigging/Removal of a sold product is the sole responsibility of the buyer and must be completed by the posted date. All purchased items must be removed from the origin location on or before the removal deadline date. Otherwise, the seller reserves the right to seek other removal options including disposal without any recourse from the buyer. The buyer would not be eligible for any refund for the purchased items. Rigging/Removal may not begin until payment has been made in full and the auction sale is complete. Recommendation or approval of Riggers by Company, by any employee or agent of Company, or by any affiliated entity of Company shall be done only as an accommodation to the buyer. Such recommendation or approval shall not cause Company to be liable in any way for any act or omission of any such Rigger. Selection of a Rigger is solely within the discretion of the buyer, and the buyer acknowledges and agrees that it shall have no rights or remedies against Company, any employee or agent of Company or any affiliate of Company based upon any act or omission by a Rigger.
Geographic Restrictions
The owner of the Website is based in the state of Florida in the United States. We provide this Website for use only by persons located in the United States. We make no claims that the Website or any of its content is accessible or appropriate outside of the United States. Access to the Website may not be legal by certain persons or in certain countries. If you access the Website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
Disclaimer of Warranties
For the avoidance of doubt, COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO ANY PRODUCT, INCLUDING ANY (a) WARRANTY OF MERCHANTABILITY; (b) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; (c) WARRANTY OF TITLE; OR (d) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE.
You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the Website will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. Limitation on Liability

Indemnification
You agree to defend, indemnify and hold harmless the Company, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the Website, including, but not limited to, any bid on, or purchase of, a Product.
Governing Law and Jurisdiction
All matters relating to the Website and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Florida without giving effect to any choice or conflict of law provision or rule (whether of the State of Florida or any other jurisdiction).
Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Florida, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Limitation on Time to File Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
Waiver and Severability
No waiver of by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.
Entire Agreement
The Terms of Use constitute the sole and entire agreement between you and Company with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.

BAJA Bid welcomes you to our Online Internet Auction! We specialize in the equipment specifically utilized in the electronics manufacturing and assembly industry. Bidders may be invited to preview and inspect all of the equipment prior to the beginning of the auction. All on-site preview / inspection visits must be scheduled in advance and completed during normal business hours (9 am - 3 pm) during the preview period. The removal of all equipment must be completed before the deadline date. A 19% Buyer's Premium will be added to the final sale price and included on the corresponding invoice. All appropriate sales taxes will be included in the total price unless the required tax exempt documentation is provided by the buyer. All winning bidders will be contacted after the completion of the auction. An invoice will be provided detailing the items that were purchased and the payment is due at that time. This entire payment must be received within 2 business days after receipt of the corresponding invoice. The preferred payment methods are cash, certified check or bank wire transfer. The payment must be paid in US dollars. The sellers have the right to set reserve prices and/or purchase their own equipment.
