New Terms and Conditions


PLEASE READ FULL AUCTIONS TERMS AND CONDITIONS BEFORE BIDDING

CONDITIONS OF THE SALE
It is the bidder's responsibility to read and understand all of the terms and conditions of the auction before bidding. By placing a bid, you are entering a legal and binding contract. By placing a bid, you are promising to pay for your purchases in a timely manner according to the terms of this agreement. Non-paying bidders will be added to the No Bid list and will not be able to bid on anything else with Somewhere In Time Antiques and Auction House. A non-payment fee will be added to your bill for Legal& Processing fees. A minimum of $1000 will be applied. We turn all non-payment bidders over to our collection agency and we will prosecute to the full extent of the law. Please do not bid if you can't or do not intent to pay for the items you win. If there is a charge back on items you bid on, you will be charged $1000 plus court cost. We try our best to get the correct measurements of items, there is no guarantees that if is totally correct. If in doubt, please email us your questions. We are not responsible for any errors.

TERMS OF THE SALE
All sales of items are sold AS IS and All SALES ARE FINAL. No guarantees, expressed or implied is given on any item. The auctioneer if not responsible for the condition of the items sold. It is the bidders responsible to determine the condition, value, genuineness of the item they are bidding on. You as the bidder are the judge of the items value.
Somewhere In Time Antiques and Auction House and its employees are not responsible for any errors that can occur in the description of the items that are up for sale. All items are sold as is and no refunds will be given if they are bought.
Please ask by email all question about an item that you are interested in but not sure of something. Do not wait until you have bided on the item to ask the question, it is too late then. Questions can be emailed to thesomewhereintimeantiques@yahoo.com, or by calling 252-458-4579. You are welcome to make an appointment to come and inspect the item you want to bid on. We want you to be happy with the items you win. Please use your own judgement in deciding on the condition of the item you are bidding on.

INTERNET DISCLAIMER
Somewhere In Time Antiques and Auction House uses Auction Flex and HiBid platforms for their internet bidding. Bidder understand that using these services may or may not work correctly at all times. Somewhere In Time Antiques and Auction House will not be held responsible for any missed bids from any of the platforms used for this auction due to any malfunctions of the internet platforms. All bidders who want to make certain that their bid is acknowledge should use the proxy-bidding feature and leave their max bid well before the final hammer drops on the items that there are bidding on.

PAYMENTS
We accept American Express, Discover, Master Card, Visa, Cashier's Check, debit cards and cash. We might ask a bidder to send a certified check to pay for their winning bids.
Surcharges for all credit/debit cards will be 0%. Cash and checks will not be charged a surcharges.

We will be emailing an invoice within 3 days of the ending of the auction. The email will list your purchases. A second invoice will be email to you is you require shipping. All invoices must be paid within 48 hours of bidder receiving their invoice. Payments must be received and cleared before any items is shipped or picked up.

SHIPPING
We can ship worldwide. Packaging, shipping and insurance on all item will be available to all won bids.
Most items will be package by us. Some items that are unusually shaped or require special packaging will be taken to a 3rd party shipper. Items that are packaged thru us will be shipped with in 5 to 7 business days after payment and shipping charges have been processed, all items that have to be shipped by a 3rd party shipper will be mailed within 7 to 14 days after payment and shipping charges have been processed. We are not responsible for the damaged items due to shipping. If any item is damaged during shipping, please contact the post office or UPS to file a claim. To file a claim, you will need the shipping/mailing label. All items will be shipped with insurance.
For any address changes or special shipping instruction please contact us immediately. We are not responsible for shipping items to the incorrect address. If items are shipped using the address on the invoice snd it is incorrect, there will be a $25.00 per box charge to correct the address change
Buyer pays all shipping and handling charges. Please keep in mind that the size, weight, degree of fragility, and insurance, all factor into the cost of shipping.

Handling charges are as following:
1. up to 5 lbs is $10.00 + the cost of shipping
2. 6 lbs to 20 lbs is $20.00 + the cost of shipping
3. 21 bs to 50 lbs will be $30.00 + the cost of shipping
4. 51 lbs and up we will call you with price
5. 10 Charge on all Box Lots and Collections + plus the cost of shipping

LOCAL PICK-UP
We offer local pick-up for those who wish to pick up their won item or items. Local pick up will be at 1553 South Church Street Rocky Mount, NC 27803 unless stated it's at an onsite auction. Please make an appointment to pick up for items by calling 252-458-4579. If items are left after 1 week after the pickup date of the auction a storage fee of $5 a day will be added to auction invoice. Storage fees must be paid the day the items are picked up. If items are left for 10 days or more the items become the property of the auction house. These items will be sold at a later date. No refunds will be given on these items.
In the event that the auction is held at an onsite auction there will be an addition pick up provisions. There will be only 1 or 2 days for pick up at these auctions. If you cannot pick up your items you can contact us to see it, we can move your items to our auction house location. There will be a charge to the bidder if we move your items our auction house location. Charges will be added to your invoice.

NON-PAYMENT/ABANDONED POLICY
All items that are unpaid or unclaimed will be considered abandoned property will become the property of Somewhere In Time Antiques and Auction House. Unpaid items are items that were won at auction but not paid for. Unclaimed items are items that have been paid for but not picked up after auction pick up week and items that have been paid but the shipping has never be paid.

COINS
The auctioneer is not responsible for the condition of the items sold. Coins are not graded by the auctioneer. The auctioneer is NOT a coin grader. Please use you own judgement to the condition and grade off any items. It is very likely all raw coins have been graded or condition Including cleaned or partly cleaned coins. all coins we sell are sold as is without guarantee or warranty of any kind. The only grading companies that guarantee their grade is PCGS and NGC. It is the sole responsibility of the bidder to do the research on the coins that they want to bid on. All coins are sold on consignment bases.

JEWERLY/SILVER/GOLD
Weights in catalogue description have been estimated through measurement and are to be used as approximate guidelines and not relied on as exact. Jewelry: Unless otherwise stated, all stones have been measured and graded in their settings. Metal weight given for jewelry includes stones unless stated otherwise. Buyers should be reminded that many colored gemstones have historically been treated to enhance their appearance. Lab reports will be referenced in catalogue descriptions. Silver: Weights provided for flatware services do not include knives and other pieces with silverplate or stainless portions.

CLOCKS AND WATCHES
No warrantee that any clock or watch is in working order is given. Virtually all clocks and watches have been repaired in the course of their lifetime and may include parts not original to them. There is no guarantee to works or movement. Unless otherwise stated, weight includes works.
