All Bidders acknowledge to have read, comprehend, and agree to the following terms & conditions set forth by Jeff Boone & Associates Auction & Realty. ("Boone Auctions"). All bidders agree to be legally bound to these terms & conditions. All announcements made by the Auctioneer shall supersede any printed material.

Boone Auctions reserves the right to deny and or terminate bidding privileges at any time.

Buyers: Once invoiced, you have 24 hours to contact Boone Auctions to notify of payment arrangements. Please email JeffBooneAuctions@gmail.com with invoice and or bidder number with payment arrangements.

All items must be paid for and removed by 6 PM on Monday, June 19th 2023. Any unpaid bills will result in revoked bidding privileges/immediate legal action. Credit cards on file for online bidders will be charged w/ a 3.99% fee if no contact has been made by this date.

Terms: Cash, Check, & Wire Transfer accepted. Credit Cards ( Master Card, Visa, or Discover) will be charged 3.99% in addition to the purchased amount. This applies to onsite and Internet bidders.

Buyers Premium: 13% for Online Bidders - 10% for Onsite/In Person Bidders
Sales Tax: No Sales Tax will be charged on this Estate Auction

All items must be paid for & removed for by 6 PM on Monday, June 19th 2023. All purchased items become the responsibility of the purchaser as soon as the item is sold. Any items not picked up by this date will be be subject to being forfeited. The Auction company is not responsible for lost, stolen, or damaged items. It is the buyers responsibility to insure purchases as needed immediately.

Pickup dates/times are as follows.
Thursday, June 15th until 6 PM
Friday, June 16th from Noon to 5 PM for items purchased on Thursday, Day 1
Saturday, June 17th until 6 PM
Monday, June 19th from 10 AM to 6 PM final day to pickup.

Immediately when an item is Sold it becomes the property and responsibility of the Buyer. It is the buyers responsibility to insure purchases as needed immediately. All items sell "AS-IS" "Where-Is" with no warranties or guarantees by the Seller(s) or the Auction company. All sales are Final. The described condition or representation of hours, use, and miles is provided as a courtesy, and not guaranteed by the Seller(s) or the Auction company. The Bidder is responsible for determining his or her opinion of the condition and authenticity of an item before purchasing the item, not after. It is the buyers responsibility to inspect the item of interest prior to bidding on it. After a bidder has won the bid, all risk of loss and damage passes to the bidder, even though the bidder may have not paid for the item yet. Buyers should guard their items accordingly. The Seller(s) and the Auction Company and all of its Associates are not responsible for loss, theft, damages, or accidents.

For Online Bidders: By placing bids you agree to follow all of the terms and conditions and make payment and take possession of purchased items. Although we strive to provide the best internet connections and software available, please understand that internet speeds and reliability will vary. The Auction company is not responsible for lost connection or software failures that result in lost or unaccepted bids. This will be a fast paced auction and quick bidding will be required.

Firearms Terms Expanded:
Jeff Boone and Associates Auction & Realty is not a test facility and assumes no liability for the safe function of any firearm. All customers when purchasing a firearm that are not capable of rendering a judgement for the ability of the firearm to function safely and properly should have a qualified gunsmith check the purchase before use.

Jeff Boone and Associates Auction & Realty does not warrant that you may legally purchase, resale, own or use specific products offered for sale at our auction. Local laws are constantly changing, it is your responsibility to investigate the products you wish to purchase and verify that they are not prohibited by any State or Local ordinances in your area before bidding.

Online Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. (Jeff Boone and Associates Auction & Realty) shall endeavor to describe in detail each item and any pertinent information about it.
Jeff Boone and Associates Auction & Realty will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.

(Jeff Boone and Associates Auction & Realty) is providing Internet pre-auction and internet bidding as a service to the Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against (Jeff Boone and Associates Auction & Realty) or anyone else if the Internet service fails to work correctly before or during the live auction. (Jeff Boone and Associates Auction & Realty) will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should leave their maximum bid 24 hours before the auction begins. (Jeff Boone and Associates Auction & Realty) reserves the right to withdraw or re-catalog items in this auction.

Online bidders may come pick up their winning firearms bids during the advertised pickup days/hours at the auction site in Whiteland. Any firearms not picked up during these allotted times will result in your purchase being taken to the following FFL Dealer where handling fees and legal transfer paperwork will be required.

ALL local and federal firearms laws will be strictly adhered to. Any firearm that accepts a primer fed cartridge or shell or any metallic cartridge of any kind (including those considered relic or curios) will only be shipped directly to FFL holders or the purchasers designated FFL licensee. No magazine fed semi-automatic firearm will be shipped to states that prohibit such weapons or high capacity magazines. No firearms will be shipped outside the 48 contiguous United States except to Alaska and Hawaii. After February 1, 2010, ammunition sold to purchasers in the state of California, can only be shipped to the purchaser's designated FFL Licensee. Ammo will not be shipped to Alaska.

Auction costs do not include shipping cost of the firearm items purchased at auction. Upon completion of purchase for the items(s) won at auction, it is the buyers responsibility to contact their local FFL holder to coordinate the transfer of the item(s) purchased. Purchasers local FFL holder will eventually need to email a copy of their transfer document (FFL LICENSE COPY) to "Guns@The2ndRight.com". In order for "The 2nd Right" to coordinate the transfer, it is the buyers responsibility to email "The 2nd Right" at the email address provided below with the following required information.

Firearm transfer fee for shipping and or pickup at FFL required will have a minimum of $20 charged per package plus postage or shipping costs to the buyer's credit card. The description and condition of the firearms were provided by the seller in most cases or by an outside consultant and are assumed correct by the auctioneers and or the auction company, but are not warranted by either the auctioneer or the auction company.

- Buyers full name in "Subject Line" of the email.
- Buyers phone number in body of email
- Brief description & number of items being transferred.
- Name of FFL Holder receiving shipment.
- Contact name of person at the receiving FFL.
- MUST CONTAIN - Phone number of receiving FFL.

Buyers receiving FFL holder will need the following information from "The 2nd Right".

Each package will vary in cost due to package size, weight, distance being shipped, packing material being used. Upon completion of packaging and figuring shipping cost, "The 2nd Right" will contact the buyer via phone for payment of shipping fees via credit/debit card.

ANY/ALL Firearms shipping to California are subject to extra paperwork fees and may require more time to complete. Any firearm rejected from the Sate of California FFL holder will require return shipping fees paid by the buyer. If shipping fees are not paid within 30 days of return, the items will become the property of Jeff Boone Auctions. Any/All items not transferred from "The 2nd Right" within 30 days from date of auction will become the property of Jeff Boone Auctions.
