All persons desiring to bid online and live must be registered prior to the auction and must have obtained a Bidder's number. Must be 18 years of age to register with valid picture ID.

JD Newell Auctioneers, Inc., herein after referred to as the Auctioneer, reserves the right to add to or withdraw from the auction any items listed or not listed, to group individual lots into larger lots for sale, to subdivide lots into smaller lots forsake, or to sell all lots in bulk when it is in the best interest of the Seller.

All items are sold AS IS, WHERE IS with no warranty, expressed or implied. The Auctioneer shall not be responsible for the correct description, authenticity, genuineness, or defect in any lot and makes no warranty in connection therewith. No allowance, or refund will be made on account of any incorrectness, error in cataloging, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the Buyer to have inspected thoroughly the merchandise and to have satisfied himself or herself as to its condition and value and to bid based upon that judgment.

The Auctioneer is acting as Agent for the Seller and all representations made by Auctioneer are made on behalf of the Seller. The Auctioneer is not responsible for the acts or representations of the Seller. Any action or recourse will be directed to the Seller and not to the Auctioneer.

Settlement must be made in full immediately upon the completion of the auction. Merchandise not paid for and removed within the specified time period may be resold without notice.

All persons attending preparation, inspection, sale or removal of merchandise assume all risks whatsoever of damage or loss to person and property and specifically release the Auctioneer of liability.
All descriptions of items for sale contained or provided orally or in writing at the time of the auction are believed to be correct, but the Auctioneer makes no representation or warranty, express or implied, as to the accuracy of any such description, and hereby specifically disclaims any such warranty.

The Buyer agrees that any item successfully bid upon will be paid for by the Buyer immediately following the close of the auction. Pay with casiers check and/ or money order or with credit /debit card. The Buyer agrees that a bid constitutes acceptance of each and every term and condition, and of any additional terms and conditions which may be posted at the auction or which may be announced by the Auctioneer.

The Buyer agrees that in any dispute between the Seller and the Buyer or between competing bidders with any sale at the auction, the auctioneer shall have the right but not the obligation to settle dispute, and the Buyer shall abide by the decision of the Auctioneer, whose decision shall be final with respect to matter.

The Buyer agrees to pay the Auctioneer for all liabilities, damages, costs, and expenses including attorneys fees incurred in connection with any dispute or in connection with any claim, litigation, controversy, dispute or proceeding from any purchase by the Buyer or from any subsequent sale to any third party.

These are IMPOUNDED VEHICLES towed by JN Wrecker service requested by the Police Department. Owner/lienholder were notified vehicle never reclaimed. YOU further agree that if, in violation of these Terms and Conditions, a credit card chargeback is initiated, these Bidder Terms and Conditions will be conclusive evidence of YOUR agreement not to initiate a credit card chargeback; and YOU acknowledge and agree that on the presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse or deny any credit card chargeback, and will re-credit all amounts to or for the account of Auctioneer. If, in violation of these Bidder Terms and Conditions, YOU initiate a credit card chargeback, even if successful, YOU will remain liable for all purchases made at the Auction, and YOU will be responsible for all costs and expenses, including attorneys' fees, incurred by or on behalf of Auctioneer and/or any Seller(s) in challenging the credit card chargeback and in collecting payment. YOUR agreement not to initiate a credit card chargeback is a condition to YOUR Registration as a Bidder, and for the privilege of bidding at the Auction, and is being made as an inducement for Auctioneer to accept YOUR Registration and to permit YOU to bid at the Auction. Auctioneer is relying on YOUR agreement not to initiate a credit card chargeback in accepting YOUR Bidder Registration and in permitting YOU to bid at the Auction.
