BY REGISTERING, ACCEPTING, AND RECEIVING A BIDDING IDENTIFICATION, YOU THE BUYER AGREE:
1: The successful Bidder of any Lot or group of lots will pay a BUYER'S PREMIUM, being the percentage as announced added to the winning bid price to arrive at the Final Price.
2: All items are sold "AS IS, WHERE IS" with all faults known and unknown. You are strongly encouraged to inspect the merchandise in person to satisfy your complete purpose and use before bidding or buy without inspection waiving the right of inspection.
3: ALL SALES ARE FINAL!
4: The public and bidders will be allowed the opportunity to physically inspect all items, and lots being offered at Live and/or Online Sale at the time announced. Due to conditions public inspection may create the Auctioneers cannot guarantee or warrant that any original depiction of Lots will contain the same items and/or be in the same condition as originally depicted. Therefore, is not responsible for any items that are missing or damaged after the Lot illustration was created. We will do all possible to ensure the original lots of items are not displaced, missing, or damaged.
5: It is the Buyer's responsibility to remove all items purchased using their bidding number the days indicated in advertising or as announced, or to make agreeable arrangements with the Auctioneers and/or Sellers to have the items purchased moved as soon as mutually agreeable. There may be a charge for premises storage after the day of sale. If no arrangements are made, or if arrangements made are not honored, the Online Sale Company will consider the items as abandoned and may resell or otherwise dispose of them.
6: Announcements and notices the day of the Online Sale Company take precedence over all prior advertising of any kind. The terms, conditions, advertising, and items of this Auction are subject to change without notice.
7: All sales are for cash, Tennessee Bank check, or credit card as agreed as evidenced by your registration by the issuance of a bidding identity.
8: The Seller reserves the right to accept below and above and stated reserve, or reject all bids, The Online Sale Company reserves the right at the direction of the seller to remove items, add items, change terms, or items at any time during the Sale to the best benefit of the Buyer and the Seller, or to settle any disputes or correct mistakes. If there are questions, immediately contact the Sale Specialists for clarification.
9: You are entirely responsible for all items bought using the bidder identity issued under your registration with this Auction. When you purchase one or more item you are obligating yourself to pay for all items purchased using your bidding number. You cannot remove any item, or items until payment is made and approved by the Bank, and you have been issued a PAID invoice, receipt, or ticket.
10: The Auctioneers, and all personnel are in fact Agents for the Seller, only, and do not and cannot warrant the quality, quantity, age, or condition of any item, or articles, in the Online Only Sale - again you are buying "AS IS, WHERE IS." Personal inspection prior to bidding is strongly encouraged on the date and time provided or bid waiving inspection!
11: The Auctioneer reserves the right to sell in lots, to the best advantage of the Seller.
12: The Auctioneer reserves the right to control the size of the bids for the speed and clarity of the sale.
13: In the event of a tied bid or disputed bid, the Auctioneer's word shall be final on whether to reopen the bidding. Be sure to clarify and settle all disputes at the time of the sale. If any dispute arises after the Online Only Sale, our sale record is conclusive.
14: When the Auctioneer sells any item, the purchaser assumes ALL RISK AND RESPONSIBILITY for the lot and/or item from the moment the Auctioneer indicates the sale. No swapping permitted - you pay for what you buy using your bidding number.
15: The Auctioneers reserve up to two business days to accurately confirm and invoice all sales.
16: THE AUCTIONEERS DO NOT MOVE, INSURE, OR SHIP ANY ITEMS PURCHASED. Please do not ask Auction personnel to move or load any item after it has been purchased for insurance reasons.
17: We appreciate your attendance and participation. Having read all the rules of this Online Only Sale, if for any reason, you cannot or will not comply with these rules, do not bid. You are welcome to stay, if in person, and observe. However, we must insist on strict compliance in every matter. Our aim is to have a fair, honest Online Only Sale for both the Seller and the Buyer. 18: Finally, A SPECIAL NOTICE TO BUYERS - IN ACCEPTING THIS BIDDING NUMBER, you, the Buyer, agree to the provisions of TCA 62-19-124, a Tennessee Act allowing Auctioneers awards of Court costs and Attorney's fee in collections for Auctioneers.
