**BY PLACING A BID, BIDDER CERTIFIES THAT THEY HAVE READ AND WILL ABIDE BY ALL TERMS AND CONDITIONS AS STATED BELOW.
**IT IS THE BUYER'S RESPONSIBILITY TO UNDERSTAND ALL THE TERMS AND CONDITIONS PRIOR TO BIDDING.

**ON-LINE BIDDING
This is a timed, Online-only Auction; the highest bid online when the bidding closes will be the winning bid for the item.
This auction will incorporate a "SOFT CLOSE". Bidding within the last minute before the closing of an item will extend the bidding time of that item. This prevents individuals from placing a bid on an item at the last second in order to prevent others from bidding more.

BUYERS PREMIUM: 15% Buyers premium applies to all on-line purchases. (Minimum of $1.00/Lot. Maximum of $300.00/Lot.)

**ITEMS SOLD "AS IS, WHERE IS"
All items are sold "AS IS, WHERE IS" with no warranty or guarantees, expressed or implied, by the seller or Koons Auctions. Bidders accept all auction items/property "WITH ALL FAULTS", whether or not immediately apparent. It is strongly recommended that bidders thoroughly inspect items before placing a bid. Items are described as accurately as possible, but do not represent any guarantee by the seller or Koons Auctions.
By placing a bid, bidder signifies that they have inspected the item or pictures of the item to their satisfaction.

**PICTURES & ITEM DESCRIPTIONS:
Multiple photos will be included in item descriptions whenever possible; however, photos may or may not fully represent the item. Lighting, surroundings and other factors can affect the perception of an item in a photo; therefore, all bidders are responsible for their own personal inspection of the item(s) before placing a bid. Photos and descriptions are to be used as a guideline only. Buyers should attend the preview and inspect the items in person.

**EMAIL:
Bidders who register for any auction will be added to our mailing and email lists. By agreeing to our terms and conditions, bidders agree to opt-in to each list. Email or mail recipients may opt-out at any time.

**AUCTION SOFTWARE:
Koons Auctions will not be held liable for any software or software malfunction discrepancies.

**INVOICING:
An invoice and payment instructions will be sent to each buyer's registered email at the close of
the auction. SHIPPING customers may be re-invoiced after any fees are added.
Please read email message completely for PAYMENT & PICKUP INSTRUCTIONS/LOCATION.
Contact us at (507) 236-2902 if you do not receive an invoice from us within 24 hours of auction close.
Payment must be received at time of checkout and pickup following the conclusion of the auction.
If payment is not received or payment arrangements made within 7 days (shipping customers have 7 days after their "Square" invoice is emailed) after invoices are emialed, the buyer will lose all right, title and interest to the item(s), including any and all moneys.
Auction items will not be released for pickup until payment is made in full.
FAILURE to comply with these terms will prohibit bidder from participating in future live or on-line auctions conducted by Koons Auctions.

SOMETIMES INVOICE EMAILS WILL BE DELIVERED TO YOUR SPAM/JUNK MAIL FOLDER.

**ITEM PICKUP:
Removal and/or transportation of item(s) won on auction shall be at the expense, liability and risk of the buyer. Any Items not removed at the allotted checkout time, unless arrangements have been made and agreed upon by seller, will be considered abandoned and the purchaser will lose all right, title and interest to the property, including any and all moneys from the buyer.
FAILURE to pickup/pay for items WILL result in buyer being PERMANENTLY BANNED from future auctions.
BRING WITH YOU: Loading HELP, Tools, Carts, Packing materials, Load straps, Chains, Binders and any other items you may need to load, pack and haul your purchases.
Some Items may need to be move up or down stairs. Bring Adequate Help With You!

**RETURNED CHECK FEES:
A fee of $40.00 + ALL costs to recover will be assessed on returned checks and may result in the bidder being denied access to future auctions.
Be sure you are capable of paying immediately after the conclusion of the auction and realize your bids are not conditional upon financing.

**PAYMENT PROCEDURES:
Payments will be made directly to Koons Auctions.
Payment IS TO BE MADE DURING CHECKOUT/LOADOUT. See Checkout/Loadout information.

CASH,
GOOD check (If shipping we will hold items for up to ten business days to ensure sufficient funds to clear the check.)
Electronic money transfer only on invoices over $100.00 a $10.00 wire transfer fee will apply.
We will accept credit card payments for invoices, a 4% convenience fee will apply.
