All persons desiring to bid online and live must be registered prior to the auction and must have obtained a Bidder's Number. Must be 18 years of age to register with picture ID. A DEPOSIT MAY BE REQUIRED.

JD Newell Auctioneers, Inc., herein after referred to as the Auctioneer, reserves the right to add to or withdraw from the auction any items listed or not listed, to group individual lots into larger lots for sale, to subdivide lots into smaller lots forsake, or to sell all lots in bulk when it is in the best interest of the Seller.

All items are sold AS IS, WHERE IS with no warranty, expressed or implied. The Auctioneer shall not be responsible for the correct description, authenticity, genuineness, or defect in any lot and makes no warranty in connection therewith. No allowance, or refund will be made on account of any incorrectness, error in cataloging, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the Buyer to have inspected thoroughly the merchandise and to have satisfied himself or herself as to its condition and value and to bid based upon that judgment.

The Auctioneer is acting as Agent for the Seller and all representations made by Auctioneer are made on behalf of the Seller. The Auctioneer is not responsible for the acts or representations of the Seller. Any action or recourse will be directed to the Seller and not to the Auctioneer.
Settlement must be made in full immediately upon the completion of the auction by cash, or credit card. Merchandise not paid for and removed within the specified time period may be resold without notice.

Upon the sale of each lot, the Auctioneer announces the final sale price and successful Bidder number. All questions or disputes regarding Buyer, lot identity, price or quantity must be resolved immediately upon the sale of the lot. No changes or adjustments will be made at any later time. The record of the sale kept by the Auctioneer and sale clerk will be taken as final in the event of any dispute.

All persons attending preparation, inspection, sale or removal of merchandise assume all risks whatsoever of damage or loss to person and property and specifically release the Auctioneer of liability.

All descriptions of items for sale contained or provided orally or in writing at the time of the auction are believed to be correct, but the Auctioneer makes no representation or warranty, express or implied, as to the accuracy of any such description, and hereby specifically disclaims any such warranty.

The Buyer agrees that any item successfully bid upon will be paid for by the Buyer immediately following the conclusion of the auction and before departing the auction premises (live auction) or by cash or credit card.

OPEN TO THE PUBLIC Lots of good deals. All vehicles have titles and if there is a key it is listed. No refunds or returns are accepted. All sales are final. Al vehicles are in UNKNOWN WORKING CONDITION and sold AS IS, WHERE IS with NO WARRANTIES implied or expressed. ITEM PREVIEW IS HIGHLY RECOMMENDED and bidding without previewing is strongly discouraged. Additional information may not be available except through personal inspection at item preview. It is up to bidder to preview. Any buyer refusing to pay for vehicles will be banned from bidding at any future auctions. PAYMENT: Payment is due immediately upon close of the auction. Your card on file will be charged automatically at close of auction unless other payment arrangements have been submitted and approved. Allow at least 48 hours for approval. If for any reason your card on file is declined, it is your responsibility to make full payment within 48 hours of auction close. Buyer agrees to NO credit card chargebacks. YOU agree that such YOU will not, under any circumstances, initiate a credit card chargeback with respect to any purchases at the Auction. YOU further agree that if, in violation of these Terms and Conditions, a credit card chargeback is initiated, these Bidder Terms and Conditions will be conclusive evidence of YOUR agreement not to initiate a credit card chargeback; and YOU acknowledge and agree that on the presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse or deny any credit card chargeback, and will re-credit all amounts to or for the account of Auctioneer. If, in violation of these Bidder Terms and Conditions, YOU initiate a credit card chargeback, even if successful, YOU will remain liable for all purchases made at the Auction, and YOU will be responsible for all costs and expenses, including attorneys' fees, incurred by or on behalf of Auctioneer and/or any Seller(s) in challenging the credit card chargeback and in collecting payment. YOUR agreement not to initiate a credit card chargeback is a condition to YOUR Registration as a Bidder, and for the privilege of bidding at the Auction, and is being made as an inducement for Auctioneer to accept YOUR Registration and to permit YOU to bid at the Auction. Auctioneer is relying on YOUR agreement not to initiate a credit card chargeback in accepting YOUR Bidder Registration and in permitting YOU to bid at the Auction.
