By bidding with our auction company, you are agreeing to the following.

-All sales are final. Everything is sold "AS IS" with no guarantees unless otherwise stated by the auctioneer. It is the responsibility of the bidder to assure him or herself as to the condition of items prior to bidding. No chargebacks are allowed.
-Condition reports given by the staff of Bontrager's Auction Service are subjective, and while we strive to be honest, we will not be held responsible or liable for any errors in description. Buyer is responsible for examining items or obtaining adequate information about the item before bidding. Auction company does not take responsibility for buyer's failure to examine or obtain information. Merchandise is not subject to adjustments once the item has been sold.
-Bontrager Real Estate & Auction Service and its staff will not be held responsible or liable for any errors in absentee/left bids or phone bids, nor for the possible failure to execute left bids for any reason.
-Payment is due in full within the time limits posted in the auction. For this auction, all payment will be made through the credit/debit card you provide when you register. We accept Visa, MasterCard or Discover. (Please note that while you may be able to register for our auction with any credit card, we will only accept Visa, MasterCard, or Discover for payment.) 13% buyer's premium and NYS sales tax added to all items purchased. Credit/debit card payments will not be taken over the phone.
-Additional Charges are as listed unless otherwise stated within the auction: -Failure to pick up auction purchases- $20. - Purchased items left at auction site- minimum $20 plus the cost of disposal. -Removal of purchases from auction site- $20 (large items such as vehilces, machinery, etc. will be subject to a $20 per hour removal fee. Storage at our auction facility- $10 per week. Packing materials needed at auction site: 50 cents per box. Packing/handling in preparation for shipping-$10-25 depending on size/weight/fragility of item. Transporting item to a shipping facility for professional packaging- $20.
-Bidders who do not contact us ahead of time to confirm shipping or deem shipping too expensive and then abandon their purchase are still responsible for payment.
-By bidding with our auction you are entering into a contract with our terms and conditions. You are accepting responsibility to perform your duties as winning bidder, and agreeing that Bontrager Real Estate & Auction Service, its employees, officers, owners, representatives, agents, and consignors will not be held liable for any losses, claims, liabilities, judgments, expenses, fees, or other damages arising from the use of our services, website, auction property, and this site, including property damage, injuries, dispute with another bidder, or breach by bidder of this site. Any liability to a purchaser will not exceed the purchase price actually paid. Failure of bidder to uphold the bidding agreement as described in the Auction Terms can result in suspension of bidding privileges at Bontrager Real Estate & Auction Service.
-Successful bidders will sign their receipt at the time of merchandise pick up indicating that all items are present and in satisfactory condition. No returns, refunds or exchanges will be issued after the merchandise leaves the pick up location.
-Bontrager Real Estate & Auction Service will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. By bidding with our company you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.
-Bontrager Real Estate & Auction Service has the right to void any sale, suspend bidding, re-sell any item/lots for any other reason.
-All sales are subject to appropriate sales tax and buyer's premium. Buyer's premium is 13% of purchase price and is subject to sales tax.
-Bids cannot be retracted once the auction begins.
-Buyers are responsible for making arrangement to pay for and pick up items within the time frames listed for the auction. Any variation, resulting in late pick up or payment will result in additional fees for removal and storage (see "Additional Fees" section). There is no delivery service for this auction. Bontrager's Auction Service is not liable for any damage to property left on the auction premises after the auction, whether or not payment has been made. We reserve the right to impose a storage fee of $10 per month for property not picked up within stated deadlines. Merchandise left 1 month after the auction is subject to sale with the proceeds covering storage and auction fees due to the auction company.
-In auctions where shipping is offered, buyer pays all shipping fees, including any tax or duty associated with shipping outside the USA. Handling charges range from $10 - $25 depending on the size/weight/fragility of the package, unless otherwise stated.
-In the event of legal proceedings arising from this contract or from the auction in connection therewith, buyer consents to being subject to the personal jurisdiction of the courts of the State of New York, Genesee County.
-For this auction, payment is by credit card only.

REQUIREMENTS:
-LOCAL FIREARMS PURCHASERS MUST PASS A FEDERAL BACKGROUND CHECK, WHICH WILL TAKE PLACE DURING THE SCHEDULED PICK UP TIMES ON JUNE 25TH.
- A DRIVER'S LICENSE WITH CURRENT ADDRESS (LONG GUNS & HAND GUNS) AND A PISTOL PERMIT (HAND GUNS).
-PURCHASERS MUST PROVE THEY ARE 21 YEARS OR OLDER TO PURCHASE HANDGUNS AND 18 YEARS OR OLDER TO PURCHASE LONG GUNS.
-OUT OF STATE BIDDERS MUST HAVE FIREARMS SHIPPED TO THE FEDERAL FIREARMS DEALER OF THEIR CHOICE, WHERE THEY WILL COMPLETE A FEDERAL BACKGROUND CHECK.
-IT IS ILLEGAL TO PURCHASE A FIREARM FOR SOMEONE ELSE. CREATE YOUR OWN BIDDING ACCOUNT AND DO NOT BID ON FIREARMS FOR ANOTHER PERSON.
-DEALERS MUST PRESENT A VALID COPY OF THEIR FEDERAL FIREARMS LICENSE IN ORDER TO AVOID SUBMITTING TO A BACKGROUND CHECK. IT IS YOUR RESPONSIBILITY TO PROVIDE THIS- DO NOT ASSUME WE HAVE IT ON FILE.
-A BACKGROUND CHECK WITH A "DELAYED" STATUS WILL RESULT IN A DELAY IN RECEIVING THE ITEM UNTIL STATE AND FEDERAL REQUIREMENTS HAVE BEEN MET.
-A FEDERAL BACKGROUND CHECK WITH A 'DENIED" STATUS WILL RESULT IN THE FIREARM BEING RESOLD IN A FUTURE AUCTION.

FIREARMS ARE SOLD AS-IS. THE LISTING IS BELIEVED TO BE ACCURATE BUT BIDDERS ARE ENCOURAGED TO REQUEST ADDITIONAL INFORMATION OR ARRANGE AN INSPECTION PRIOR TO BIDDING. IT IS THE RESPONSIBILITY OF THE BUYER TO SATISFY ANY QUESTIONS THEY MIGHT HAVE REGARDING CONDITION PRIOR TO BIDDING.

This auction includes firearms, ammunition, and firearm literature. Buyers will be picking up their purchases in Alexander, NY on June 25th between 9 a.m. - 3 p.m. PREVIEW: FIREARMS ONLY PREVIEW: MONDAY, JUNE 21, 5-7PM AT 8975 WORTENDYKE RD., BATAVIA, NY. There is no live preview for non-firearm items in this auction. Some items may have damage and are sold as-is. Please read descriptions and look at pictures carefully. MERCHANDISE PICK UP LOCATION/DATE: Alexander, NY on Friday, June 25th 9 a.m. - 3 p.m. by appointment only. Address will be shown to bidders when they confirm their appointment. PICKUP OF FIREARMS: All buyers of firearms must pass a federal background check before taking possession of their purchase. Background checks will take place during the regular pick up hours (Friday, June 25th, 9 - 3 p.m. by appointment). Pistol permit (handgun) and driver's license with current address (long guns and hand guns) will be required for the background check. SHIPPING: We do not automatically ship every lot. Bidders must contact the auction company to confirm that we will ship a specific item by clicking the "contact auctioneer" button located below the item description, calling our office at 585-343-4529 or emailing todd@bontragerauction.com to confirm that we will ship an item prior to bidding on it. Firearms can only be shipped to Federal Firearms Licensee (FFL). We will ship ammunition to a federal firearms dealer only. We charge for materials and packaging time, and we do not ship to PO Boxes. We are unable to overnight express packages. Fragile items (glass, lamps, etc.) will be taken to UPS for professional packaging. Buyer pays shipping, insurance, signature confirmation and handling fee. There is a charge to move items from the auction site to our auction center. Please read our full shipping policy so there are no surprises. PAYMENT: At the close of the auction all payments will automatically be charged to the buyer's credit/debit card used at registration. MERCHANDISE PICK UP PROCEDURE: -All buyers of firearms must pass a federal background check before taking possession of their purchase. -Bring your own copy (paper or electronic) of your receipt. It is the buyer's responsibility to make sure all items are loaded and in expected condition. Once the item leaves the premises, there will be no exchanges, returns, or refunds. -If you are unable to pick up on the scheduled date, please send someone in your place or kindly refrain from bidding in this auction. We are unable to accommodate multiple dates for pickup. There is a $20 charge, plus staff time, trucking fees, and storage for bringing items to our auction center from the auction location. Items not picked up on the scheduled date will be resold to cover our fees. -Customers will be assisted by appointment times for pickup. Sometimes it will be necessary for customers to enter the building to remove merchandise. Masks are required by NYS law, and the number of people in the building will be limited (by appointment time). Customers should come prepared to remove the items themselves and bring any assistance or tools they may need. Buyers who have bought large lots should make early appointments to allow for the time needed to load.
