* All items sold "AS IS, WHERE IS" descriptions believed accurate but not guaranteed. * By placing a bid, bidder signifies that they are bidding regardless of item condition. * 12% Buyer's premium rate charged to all winning bids of personal property, and 5% buyer's premium on the vehicle. * SALES TAX will NOT be charged FOR THIS AUCTION except for on titled vehicles. * 3% user fee will be charged for Visa/MC/Discover/AE credit card transactions. * We reserve the right to cancel and/or reopen the auction bidding. * ITEMS NOT PICKED UP in the allotted pickup times are FORFEITED without refund & subject to resale without notice for STORAGE FEES. NO REFUNDS WILL BE ISSUED. * Graber Auctions may reserve the right to reject any bid at it's sole discretion. Items need to be picked up on Thursday, July 22nd, from 10:00-5:00pm ET by APPOINTMENT ONLY (A calendar will be sent to winning bidders). Shipping is available for small items only, with United Packing and Shipping, (812) 886-9499. (Hazardous items cannot be shipped such as liquids, perfumes, ammo, chemicals, radioactive materials, compressed gases, dry ice, liquid nitrogen, lithium batteries and more). Deposit: In order for the Auctioneer to process your winning bid, we must have a working Visa, MasterCard or Discover associated with your account. Photographs and Descriptions: The Auctioneer regularly posts item descriptions and photographs to aid bidders in the bidding process, and we make every effort to ensure that the descriptions and photographs that we post accurately represent the items being offered for sale. In some photographs, multiple items may appear to be joined as a single unit, however you should not assume that a lot consists of more than one item simply because various items appear connected or are featured in the same photograph. Also understand that, on occasion, the wrong photograph may be displayed for a given item. The Auctioneer reserves the right to at any time (1) add or remove items from the auction, (2) split or combine lots. Winning Bids: If you place a bid in this sale, and your bid is determined to be the winning bid, you become obligated to pay for the item that you have won at the price you gave as your bid. Payment: At the conclusion of this auction, the credit card associated with your account will be automatically charged for the full price of your purchases. ------------------------------------------- Real Estate Terms: Auction Terms & Conditions NOTE: Owner has the right to reject final bid on Real Estate. The high bidder will receive confirmation by 12pm on Wednesday (July 21st). REAL ESTATE TERMS: $5,000 down payment along with the 1% Buyers Premium. The down payment will be required upon acceptance of bid & applied to the purchase price. The down payment may be made in the form of check or cash, and will be applied to purchase price. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing if needed. The Balance will be due at closing. Property is offered in "AS IS" condition. All inspections must be made prior to auction at bidders expense. Closing cost will be split between buyer & seller. Seller will provide a clear, marketable title to the purchaser. Property is not being offered subject to financing. Please have financing arranged before auction. The successful bidder will be required to sign a Purchase Agreements upon acceptance of final bid. (The final bid is subject to the Sellers acceptance or rejection). DOWN PAYMENT: A $5,000 down payment along with the 1% Buyers Premium will be required on the acceptance of bid and upon signing of purchase agreement. The down payment will be applied to the purchase price and may be made in the form of check or cash and is non-refundable. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, be sure you have arranged financing if needed. ACCEPTANCE OF BID PRICES: The successful bidder will be required to sign a Purchase Agreements upon acceptance of final bid. (The final bid is subject to the Sellers acceptance or rejection). EVIDENCE OF TITLE: Seller shall provide an owners title insurance policy in the amount of the purchase price. DEED: Seller shall provide Warranty Deed(s). CLOSING: The balance of the purchase price is due at closing, which will take place in 45 days after the auction, or as soon thereafter as applicable closing documents are completed by the Seller. Costs for an administered closing shall be shared 50/50 between Buyer(s) and Seller(s). POSSESSION: Possession will be given at closing. REAL ESTATE TAXES: Real Estate taxes shall be prorated to the date of closing. PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries and due diligence concerning the property. Seller disclaims any and all responsibility for Bidders safety during any physical inspection of the property. SURVEY: The cost of the survey, if needed, will be the responsibility of the buyer.
