TERMS OF SALE - The terms and conditions for this auction are absolute and cannot be altered in any way. If you do not understand any of these conditions, please contact Wester Auction BEFORE bidding. Once you place a winning bid you have entered into a legally binding contract.

WARRANTY EXPLANATION - Everything is sold "AS IS, WHERE IS" without guarantees of any kind. If you bid without inspecting the item(s), then you accept FULL RESPONSIBILITY for the condition and completeness of the item(s). It is YOUR responsibility to inspect items BEFORE you bid on them. The only exception is if we give the item an ON SITE GUARANTEE.

PAYING FOR YOUR ITEMS - You may pay for your items when you come to remove them with cash, check, or credit/debit card. Customers paying with cash or qualified check will receive a 3% discount. Failure to pay for your items by the end of the removal period will result in the suspension of your bidding privileges at future auctions. At 5:00 PM on the day of removal all outstanding invoices will be charged to the card on file.

FAILURE TO PAY YOUR INVOICE: Any buyer that defaults on an unpaid invoice, FOR ANY REASON, will be responsible for losses and expenses incurred in reselling the items on the invoice. In accepting the Terms and Conditions of Sale you agree for us to charge any losses or expenses incurred to the card on file. Failure to cover the expenses will result in immediate suspension/revocation of bidding privileges, civil suit, or both.

DESCRIPTION OF ITEMS - While descriptions and counts are believed to be accurate, they are NOT GUARANTEED. Buyers need to rely solely upon their own inspection and information. Please come to the preview.

HOLD HARMLESS AGREEMENT - The buyers hereby indemnify and hold harmless the auctioneer and seller(s) from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the sale or during the removal of the items purchased. Buyers remove purchases at their own risk.

REFUNDS AND ADJUSTMENTS - ANY CLAIMS MUST BE MADE WHILE THE ITEMS ARE ON THE AUCTION PREMISES. Absolutely no adjustments, claims or refunds will be allowed after the item(s) are removed from the auction site. In no event will auctioneer's or seller's liability to buyer ever exceed the purchase price paid.

BUYER'S PREMIUM - The expenses of conducting the auction are shared between the seller and buyer. The buyer's expense is called a BUYER'S PREMIUM and is set at 13%. Payment with cash or a pre-qualified check qualifies the buyer for a 3% discount from the buyers premium.

SELLING TIMES THE MONEY - If there is a small box in the corner of the picture with an "x" and "number", then you are bidding one one unit and your bid will be multiplied by the number of units.

REMOVAL SELECTION - If we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.)

REMOVAL PERIOD - The scheduled removal time is clearly stated in the Terms of Sale.. Any item remaining after the SCHEDULED REMOVAL PERIOD is subject to be considered ABANDONED, with no refund or recourse to the buyer.

INVOICE - Your invoice will be emailed to you within one hour after the auction has been completed.

RESERVES - The seller(s) reserve the right to set a minimum acceptable price on an item. According to NC State Law the auctioneer may bid for the seller(s) up to but not above the set reserved price.

We have over 250 lots of clean, quality equipment that must be sold. Items from several area restaurants, both large national franchise operatiors, and local family owned restaurants. Almost all items have been cleaned and are ready to install. Watch for the "ON SITE GUARANTEE" tag on the item. This means you can ask to see the unit working before you pay for and load it.
