Personal Property Online Auction Terms and Conditions ***THERE WILL NOT BE ANY EXCEPTIONS MADE TO THE TERMS STATED BELOW. YOU ACKNOWLEDGE AND AGREE TO THESE TERMS UPON REGISTRATION FOR THE AUCTION*** You Must Be 21 Years Of Age To Purchase Alcohol. Proof Of Age Will Be Required At Pick-Up. INTERNET BUYERS PREMIUM OF 10% ON ALL MERCHANDISE. The credit card used for registration will be charged following the auction unless you specifically call us ahead of time to arrange for different payment or leave this information in "The Notes To The Auctioneer" at the time of registration. If alternative payment is approved, we accept cash. Please note the 10% buyer's fee applies to all purchases regardless of payment method. A 5.5% State Sales tax will be applied to all sales unless you present a sales tax exemption form. The credit card bidders choose to use for registration will be authorized at that time. We accept Visa, MasterCard & Discover ONLY. Credit card chargeback's will not be accepted. Auction Company reserves the right to request a different form of payment (wire transfer or check) for larger amounts. Please note that the merchandise must be pickup up during specified pickup times. There is no storage available. Buyers should bring their own moving personnel and equipment, if needed. Items Not Picked Up During The Scheduled Pick-Up Times, You Will Be Charged $20.00 Per Lot For Transportation Back To Our Office. This only applies to smaller items; we will not transport large items. If You Do Not Pick-up Your Items Or If You Fail To Make Arrangements For Pick-up, Your Items Will Be Disposed Of or Resold At Our Discretion. You Forfeit Your Rights To These Items, Even Though You Have Already Been Charged. NO EXCEPTIONS WILL BE MADE! The Buyer shall be responsible to Wagenson Auction Service LLC, for any expenses of resale and collection and damages resulting from the resale. By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. All property is sold 'AS IS, and ALL SALES ARE FINAL. It is the Bidder's responsibility to determine condition, age, authenticity, value or any other determinative factor. Wagenson Auction Service, LLC may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Wagenson Auction Service be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. We Highly Encourage Attending Or Scheduling Inspections Before Bidding. Wagenson Auction Service LLC on-line auctions are timed events and all bidding will begin to close at specified times. Wagenson Auction Service, LLC Online Auctions feature a Soft Close. The Soft Close feature remains active until no further bids are received on an item within said items two minute closing window. When a bid is placed in the final two minutes of an item closing, the auction bidding will automatically be extended two minutes from the time the bid was placed. For Example: If an auction is scheduled to begin closing lots at 6:00PM and a bid is received at 5:59PM, the close time on that lot will automatically extend two minutes. Items will close every twenty seconds there after unless there is still active bidding on said item, in which case that specific items closing time will be extended the two minutes until all active bidding has ended. Bidder agrees that this agreement shall be governed by the laws of the state of Wisconsin and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Juneau County, Wisconsin. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid, to them at the address they provided to register. Should a dispute arise between Wagenson Auction Service, LLC and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Juneau County, Wisconsin. Bidders who bid from offsite understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Wagenson Auction Service, LLC will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. Wagenson Auction Service, LLC is providing Internet bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the days of the auction. Under no circumstances shall Bidder have any kind of claim against Wagenson Auction Service, LLC or anyone else if the Internet service fails to work correctly before or during the auction. Wagenson Auction Service, LLC will not be responsible for any missed bids from any source. Wagenson Auction Service, LLC reserves the right to withdraw or re-catalog items in this auction.
