AUCTION TERMS

AGREEMENT OF TERMS
By registering for this auction, you agree to the terms of the auction.

REGISTRATION
All bidders must register for each auction, whether on-site or on-line, in order to receive a bidder number. In order to register for the auction, the registrant must provide a picture identification showing their current name and address. Registrant must also provide contact information which includes telephone number and email address.

BUYER'S PREMIUM
A 5% Buyer's Premium will be added to the bid price for all purchases made on-line or by absentee bid.

PAYMENT
Payment is due at pick up. Cash or check are preferred. We also accept credit card or PayPal at Bforcolts@gmail.com

DEFAULT OF PAYMENT
Payment is due at the conclusion of the auction. Any invoices remaining outstanding after the payment due time, may be accessed a collection fee as well as all other remedies allowed by law. The auction company may retain any monies received as deposit as liquidated damages. Lots not paid for within the time specified may be resold at public or private sale, without further note. Any resulting deficiency together with all expenses and costs of re-sale will be the responsibility of the defaulting purchaser.

BIDDER NUMBER
Once registrant has completed the necessary requirements; they will be issued a bidder number. Bidder is responsible for payment of any items purchased on this bidder number; whether it be by them or by any party they have allowed to use their bidder number.

CONDITION AND WARRANTIES
All items are sold "AS IS, WHERE IS" with no guaranties of condition, whether implied, or otherwise given. Great effort is given to providing the description and condition of each item; when known. Auction Company will not be held responsible for errors in the description or condition of any item. It is the buyer's responsibility to determine the authenticity or condition of any item prior to bidding. No refunds will be issued on any item sold due to errors, omissions or condition of items sold. The buyer agrees to indemnify and hold the auction company, auctioneer and staff and seller harmless from any future claim that shall pertain the fitness or use of that asset as being purchased.

BIDDING
Bidding may be available on-site, on-line or in conjunction with each other. Lots may be offered in various ways including a single lot, multiple lots, split lots, etc.; which will be at the discretion of the auctioneer and auction company. Bidding will continue until the highest bid has been obtained; the auction company will have rights to refusal if the bid does not meet their requirements. Upon approval from the auction company the highest bidder will be the winning bidder; all other bidders will be considered null. The auctioneer, at their discretion, may offer additional lots to the "back-up" bidder(s) at the winning bidder's price; back-up bidders have the right to accept or decline the offer. The Auction Company, its employees and contractors, and the seller have rights to bid during the auction. Auction Company and auctioneer have the right to reject any bids that are merely nominal bids; if in their judgment it may adversely affect the sale.

DISPUTE BETWEEN BIDDERS
Disputes between bidders determining the winning bidder will be handled as follows: the auction company or its' auctioneer may decide the winning bidder, or may resell the items immediately. The decision of the auction company, or its' auctioneer, shall be final.

CHANGES TO AUCTION LOTS
The auction company reserves the right to change any lot whether it be number order, content, grouping, division, addition or withdrawal of lots at any time. Once the auctioneer says sold the lot can no longer be changed.

SECURITY
All items become the sole responsibility of the buyer once auctioneer has said sold and has confirmed you are the successful bidder. It is your responsibility to secure your items, no refunds or adjustments will be given for lost or stolen items or for shortages.

REMOVAL
Removal of purchased items shall be at the expense, liability, and risk of the purchaser. Purchases may be removed upon presentation of a paid receipt to the Auction Staff. Purchases may only be removed during the allotted pick-up period. Removal dates/times will be announced at each auction. Any item(s) not removed during this period may be considered abandoned and no refund will be given. Abandoned items may be resold without notice at public or private sale or otherwise be disposed of at purchaser's expense. No refund will be given for abandoned items.

PERSONAL AND PROPERTY RISK
Persons attending during preview, sale, or removal assume all risks of damage or loss to person and property and specifically release and indemnify the auction company and staff from liability therefore.

Additional terms and conditions of sale may be announced and/or posted at the time of sale. All announcements made the day of sale take precedence over other advertisements, notices, terms and other published information relating to the auction.

Listing Information
This charity auction has been created in honor of Jack's House. The auction is an Online Only Auction; which will run now through Sunday, February 21st with lots beginning to close at 7 pm est. From the creator of Jack's House, Beth Clemens Forsythe: For the past several years, our family has raised money for Alzheimer's. One way has been to have a euchre tournament with a silent auction where we would have a full group of teams and people attending for the auction and dinner, usually over 250 people. Because of Covid-19, we had to cancel our tournament last year. We had already collected many items for our auction and decided to keep them for this years' auction. However, we had to cancel again this year so thanks to Cheryl & Chuck, we are offering what we collected last year in an on-line auction to raise money for Alzheimer's. We raise money in memory of our dad, Jack Clemens. He was a life -long resident of Boone County, president of his class at Whitestown High School where he played baseball, basketball and wrestled. He retired after 40 plus years from Rock Island Refinery. During the years his children were growing up, he coached Little League. He was a huge fan of Lebanon High School sports, never missing a basketball game. He loved his family, animals, being outside. He built his house on State Road 32 East mostly by himself. That's where we got our name for our Alzheimer's team for the walk to end Alzheimer's - Jack's house. Thanks to our community, family & friends, Jack's House has raised over $100,000 for the indiana Alzheimer's Association. We will continue to raise money and fight for those who can't. We are fighting for memories. We are fighting for a cure. Right now, there isn't a cure for Alzheimer's and there isn't any survivors. Alzheimer's is the 6th leading cause of death. In the past 20 years, the number of deaths from Alzheimer's has increased 146% while the number of of cases of heart disease deaths have decreased 7.8%. This disease is one that doesn't have ANY SURVIVORS. It's a slow, painful death for the whole family. We will continue to raise money for Alzheimer's so others do not have to go through this. Please help us raise money for the Indiana Alzheimer's Association. If you need more information on this disease, please let us know.
