TERMS OF SALE - The terms and conditions for this auction are absolute and cannot be altered in any way. If you do not understand any of these conditions, please contact Wester Auction BEFORE bidding. Once you place a winning bid you have entered into a legally binding contract.

WARRANTY EXPLANATION - Everything is sold "AS IS, WHERE IS" without guarantees of any kind. If you bid without inspecting the item(s), then you accept FULL RESPONSIBILITY for the condition and completeness of the item(s). We do not guarantee items that do not belong to us.

INTERNET BIDDING - Due to varying Internet speeds, browser controls, wireless signals, and other communication problems we DO NOT GUARANTEE that your bid will be accepted on any item. Do not wait until the last possible second to place a bid. If an item is not on your invoice, then your bid was not the last and highest bid recorded and there is no recourse.

PAYMENT - The winner of the bid will post a 25% non-refundable deposit within 24 hours after the bidding ends. The winner will then have 14 days to negotiate and sign a new lease with the landlord. Full and final payment is due 15 days from the close of bidding. If the winner wishes to move the package to a different location, then full payment is due BEFORE anything leaves the building.

SIGNING A NEW LEASE - The winning bidder will be given the name and contact information for the landlord immediately after the deposit has been paid. The landlord is reasonable and wishes for the operation to continue. If you feel there is something in your history that would prevent you from being approved for a lease, we recommend that you refrain from bidding. THE 25% DEPOSIT IS NON-REFUNDABLE.

DESCRIPTION OF ITEMS - While descriptions and counts are believed to be accurate, they are NOT GUARANTEED. Buyers need to rely solely upon their own inspection and information. Please come to the preview.

HOLD HARMLESS AGREEMENT - The buyers hereby indemnify and hold harmless the auctioneer, seller, and the property owner from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the sale or during the removal of the items purchased.

BUYER'S PREMIUM - The expenses of conducting the auction are shared between the seller and buyer. The buyer's expense is called a BUYER'S PREMIUM and is set at 10%.

CREDIT/DEBIT CARD PROCESSING FEE - If you choose to use a credit or debit card to settle your invoice your buyer's premium will be increased from 10% to 13% to cover the processing fees.

The rent and utilities are EXTREMELY reasonable. It even comes with a delivery van. +/- 30 minutes to downtown Raleigh and +/- 20 minutes to the center of Durham. You are out of the traffic, but close enough to service your customers.
