Auction Terms & Conditions Thank you for participating in Strawser Auction Group's Online Auctions. It is important that you familiarize yourself with the terms and conditions as all sales are final and irrevocable. The terms of sale are non-negotiable.
--- BIDDERS PACKET: All bidders who have registered for the online auction can view copies of the terms on the specific property Auction Detail Page.
--- ONLINE REGISTRATION: Registration for this auction (online) finalizes each bidder's agreement to the terms and conditions of sale which are incorporated by reference into your bidding. Do not bid until you have read the terms and conditions.
There is no fee to register but a valid credit card (Visa, Mastercard, or Discover only) will be required to verify identity. By bidding you are representing to Strawser Auction Group and the Seller that you have read and agree to be bound by the terms and conditions for this sale as stated herein. If you do not agree with any of the terms and conditions stated, DO NOT BID as you will be bound by those terms and conditions.
--- CONDUCT OF THE AUCTION: The Seller and selling agents reserve the right to preclude any person from bidding if there is any question as to the person's identity, credentials, validity of the credit card, fitness to bid, financial ability to buy, etc. All decisions of the Auctioneer are final. THE SALE WILL BE CONTROLLED BY THE AUCTIONFLEX/BIDOPIA SOFTWARE. Strawser Auction Group is not responsible for malfunctions or system errors which cause a bid or bidder to fail to be recognized or registered. If there is a dispute, the Auctioneer may re-open the bidding at the Auctioneer's sole discretion and shall serve as the sole arbiter as to who is or is not allowed to bid. Seller reserves the right to cancel or withdraw any personal property item at any time and approve all final bids.
--- BIDDING: Bidding starts at the nominal Opening Bid(s) indicated and is open to all who registered and are approved by the way of verified identity and credit card information. The bidding will be open for minimum of 7 days. The auction ends at a predetermined time with an Overtime Period if necessary, which is defined as follows: if a bid is placed within ten (10) seconds of the close of bidding, then another two (2) minute period commences from the time of the last bid until no bids are placed within the next two (2) minutes. The last bid shall be made final. The Bidder is responsible for knowing which item he is bidding on. Auctioneer cannot honor "mistakes".
--- AGENCY DISCLOSURE & GENERAL OFFICE POLICIES: Strawser Auction Group represents the Sellers only and does not inspect merchandise on bidder's behalf.
--- DISCLAIMER & ABSENCE OF WARRANTIES: All items are sold "AS IS, WHERE IS" basis. No warranty or representation, either expressed or implied, concerning the Personal Property, its condition, or the condition of any other components on the Personal Property, is made by the Seller or Strawser Auction Group. The information contained online or in the catalog is subject to verification by all parties relying on it. No liability for its accuracy, errors, or omissions is assumed by the Seller or Strawser Auction Group. Each potential bidder is responsible for conducting his or her own independent inspections, investigations, inquiries, and due diligence concerning the personal property.
--- BUYER'S PREMIUM: A Buyer's Premium of 10% will be added to the winning bid and included in the total purchase price in addition to any applicable sales tax and a 3% credit card surcharge.
--- PAYMENT: All purchases will be processed on the Credit Card (Visa, Mastercard, or Discover only) provided during registration. *A $25 service fee will be charged to any account whose credit card on file is declined for any reason. Shipping charges are separate and the shipper will contact you for payment.
--- EXECUTION OF WINNING BID: Within 24 hours immediately following the close of the auction, the Buyer will be contacted by the Auction Company via email with their paid invoice copy showing a listing of items won at auction.
--- SHIPPING/ PICK-UP/REMOVAL/FEES: Packing, shipping, and insurance is the responsibility of the buyer. Paid items must be removed from the auction facility within fourteen (14) days. It will be up to the buyer to determine if there are any shipping regulations for any item(s) purchased, and the buyer is responsible for any shipping regulation requirements. No refunds will be allowed for any item(s) that cannot be shipped due to said regulations. While Strawser Auction Group does not provide packing and shipping services, at the conclusion of the auction you will receive an email (**Please check your spam/junk folder)from jenny@strawserauctions.com with a list of shipping companies that service our area along with a shipping release form. You will need to select a shipper and then return the release form to us. Strawser Auction Group is not liable for any loss or damage to the property once it is released to the approved shipping agent.

When entering your name to schedule your appointment, USE THE NAME THAT APPEARS ON YOUR INVOICE. Out of state buyers picking up in Indiana will have to pay Indiana Sales Tax; if you have an exemption, please email jenny@strawserauctions.com with a copy.
If the winning bidder cannot pick-up the items on the above allotted dates and times, there will be a $25 fee charged for a Strawser Auction Group member to meet the winning bidder on a different date and time.
Paid items must be removed from the auction facility within fourteen (14) days. After fourteen (14) days, any item(s) remaining at the auction facility will be placed in storage. Fee for storage will be $10 per day, per item. If item(s) remains in storage for more than 60 days it shall become the property of Strawser Auction Group.
--- DEFAULT: If the winning bidder refuses or fails to complete the transaction for ANY reason (including, but not limited to, remitting the total purchase amount, or arranging pickup of the item), Buyer shall relinquish ANY right to complete the transaction and shall have no rights or interest in the property, as well as forfeit all deposit monies as liquidated damages to Seller. PLEASE BE ADVISED: Various state statutes give Seller the right to pursue legal action against bidders who refuse to complete transactions. This may include (but is not limited to) suit to compel completion of the sale, and/or criminal charges of fraud or other intentional act.
--- AUCTIONEER RIGHTS: Auctioneer Reserves the right to make changes to an auction, to split or combine lots, cancel, suspend or extend the auction event.
--- DISPUTES: If any dispute arises concerning any part of the online auction process, payment of items, quality, quantity of merchandise being sold or if an item has been paid for by a buyer and then the item is no longer available for buyer to obtain. The auctioneer has final say so on resolving said dispute and auctioneer may elect to refund to the buyer their total funds used to purchase said items as resolving the dispute. If the auctioneer elects to refund buyer their money, buyer herein agrees that this will terminate all said buyer's rights to any future claims against Strawser Auction Group and the seller concerning this matter.
YOU ARE ENTERING INTO A BINDING CONTRACT. THERE ARE NO REFUNDS OR BID CANCELLATIONS. THE REGISTERED BIDDER IS PERSONALLY RESPONSIBLE, LEGALLY AND FINANCIALLY, FOR ALL AUCTION ITEMS BID UPON WHETHER REPRESENTING ONE'S SELF OR ACTING AS AN AGENT. TERMS FOR FIREARMS PURCHASE:
Terms and Conditions: Stryker Action Firearms will be the FFL dealer in charge of all transfers of firearms. Stryker Action, 4690 S 1200 E, Hudson, IN 46747. Phone 260-351-3410. There will be a transfer fee of $25.00 per firearm transferred. All sales must take place in the US. No foreign bidders permitted of firearm sales. 1. A buyer's premium of 13% of the hammer price shall be added to each purchase to reach the total sales price. 2. Acceptable forms of payment are Visa, MasterCard, or Discover. 3. FIREARMS LAWS. All firearms are sold in accordance with Federal and Indiana State Laws. All post - 1898 (Modern) firearms must be registered in compliance with Federal and State Law. Purchasers of modern firearms who are Indiana residents must complete state and federal registration forms at Stryker Action Firearms, 4690 S 1200 E, Hudson, IN 46747 (260-351-3410) or provide a signed copy of a Federal Firearms License from a dealer that your purchase can be shipped to. FFL Dealers and out-of-state buyers must have in their possession signed copies of their Federal Firearms License in order to accept delivery of modern firearms. Buyers who act as agents for FFL dealers must have a letter of agency as well as a signed copy of the dealers Federal Firearms License (FFL). Internet bidders who are out-of-state buyers and FFL dealers must fax a current FFL license within 24 hours of the close of the auction to Stryker Action. 4. Complete payment is required within 12 hrs of the close of auction and will be charged to your credit card on file. Items must be paid for immediately following the auction. *A $25 service charge will be charged to any account whose credit card on file is declined for any reason and at that time, the sale will be deemed null and void and the items will become the property of the auctioneer. 5. Packing, shipping and insurance are handled by Stryker Action Firearms. There is a packing fee of $50.00 per gun plus shipping and insurance. All items will be shipped UPS-ground or required overnight parcel for handguns with insurance. All shipping quotes are for shipping within the continental U.S. only. All shipments will be to an FFL dealer in your state of residence. 6. The highest bidder shall be the buyer and if any dispute arises between two or more bidders, the auctioneer will decide the buyer or immediately put the item up for sale again. 7. The auctioneer's decision will be binding and final. 8. The record of sale, controlled by the Auction Flex/Bidopia software, will be taken as absolute and final in all disputes. 9. The auctioneer will not be held responsible for error or failure to execute bid. 10. All auction inquiries must be received 24 hours prior to the start of the auction. The deadline for email inquiries is 12 pm EST the day prior to the scheduled auction. 11. The Auctioneer makes no warranty as to condition and shall not be responsible for any defects in any Lot. Any used firearm should be inspected by a competent gunsmith for safety, function, and proper ammunition type/size before attempting to fire. Any description of mechanical function or condition does NOT mean the gun has been inspected or tested for firing capabilities. Item descriptions, dimensions, and photos are provided for guidance. It is the buyer's responsibility to inspect all lots prior to bidding to ensure that the condition is to their satisfaction. Our staff will be happy to prepare detailed Condition Reports on individual lots. These are for guidance only, and all lots will be sold as described, as per our Terms and Conditions of Sale. All goods are sold "AS IS" and "WITHOUT RECOURSE". 12. We have tried to describe each lot as accurately as possible, and we have included descriptive photographs as well. However, we are selling each lot "AS IS" and there will be no returns allowed if you are not satisfied with condition. Please satisfy yourself as to the condition of the item before bidding. 13. Your bidding at this Auction indicates that you have read and accept these Terms & Conditions of Sale. 14. We are not responsible for color discrepancies due to photo reproductions. Any firearms sold containing prohibited magazines as mentioned above will be shipped less the banned magazine, no refunds will be offered.
