TERMS OF SALE - The terms and conditions for this auction are absolute and cannot be altered in any way. If you do not understand any of these conditions, please contact Wester Auction BEFORE bidding. Once you place a winning bid you have entered into a legally binding contract.

DUE DILIGENCE - This property is offered in "AS IS" condition without guarantees of any kind, except a General Warranty Deed. If you bid without inspecting the property, then you accept FULL RESPONSIBILITY for the condition and completeness of the property. It is YOUR responsibility to inspect the property BEFORE you bid.

CONTIGENCIES ALLOWED - This is a cash only sale with no contingencies allowed for the sale of other property or the bidder's ability to obtain financing.

INTERNET BIDDING - Due to varying Internet speeds, browser controls, wireless signals, and other communication problems we DO NOT GUARANTEE that your bid will be accepted. Do not wait until the last possible second to place a bid.

DESCRIPTION OF THE PROPERTY - While descriptions are believed to be accurate, they are NOT GUARANTEED. Buyers need to rely solely upon their own inspection and information. Please conduct your due diligence BEFORE November 15.

HOLD HARMLESS AGREEMENT - The buyers hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the sale or inspection of the property.

BUYER'S PREMIUM - The expenses of conducting the auction are shared between the seller and buyer. The buyer's expense is called a BUYER'S PREMIUM.

EARNEST MONEY DEPOSIT - The high bidder will receive an email with the Offer to Purchase and Contract within one hour after the bidding concludes. The high bidder has 6 hours to present cash or wire transfer for 10% of the Contract Sales Price, along with the completed Offer to Purchase and Contract. If the buyer is within a 3-hour driving distance of Johnston County, Wester Auction will send a courier to retrieve the documents and the earnest money deposit. If the buyer is outside of the 3-hour distance, the earnest money deposit will be done with wire transfer or direct deposit into a Bank of America account provided by Wester Auction. The Offer to Purchase and Contract will be delivered by email for electronic signatures.

CLOSING - Closing must occur with 30 days of the Contract Sales Date. The closing will be with an attorney of the buyer's choosing. This is a cash closing. The buyer must present the remaining balance at closing with cash or certified funds.
