By bidding with our auction company, you are agreeing to the following:

Payment is due at the close of the auction and can be made with cash, good check, Master Card or Visa. Any other payment arrangements must be made with the auctioneer prior to the close of the auction.
13% buyer's premium and NY state sales tax are added to all totals. A 3% discount is taken from the buyer's premium if payment is made with cash or check.
Tax exempt buyers must present tax exempt paperwork and ID number at the time of registration.
All purchased items must be removed from the premises at the close of auction.
Left bids will be accepted until 6 p.m. Friday, September 13th. In order to ensure that your bids are processed, we are unable to accept bids after that time. Left bids must be picked up by the end of the auction week (close of business on Friday). Please refer to our left bid policy (http://www.bontragerauction.com/absentee-bid-policy/) for more information.

Firearms purchasers must produce current driver's license, pistol permit (for the purchase of handguns), complete a 4473 Firearms Transaction Record and submit to a NICS background

Firearms are sold as-is: The firearm listing is believed to be accurate; however you are encouraged to inspect any firearm you wish to bid on, to confirm specific details. All firearms are sold as-is.

Requirements for Firearms Purchase: Unless indicated otherwise, all firearm purchases require a Criminal Background Check of the buyer. Purchasers must be over 18 years of age to purchase a rifle or shotgun and over 21 years of age to purchase a handgun. Non-New York State residents can purchase firearms only if they are a Federally Licensed Firearms Dealer (FFL) or if they are having the firearm sent to an FFL holder in their state for transfer.

During the auction, purchasers of firearms will be required to fill out one ATF 4473 form (no matter how many firearms are purchased) and submit it immediately to auction staff so that a Criminal Background Check can be conducted. This is in accordance with federal and New York State Law. Winning bidders can pay for their purchases once the Criminal Background check has cleared and a "Proceed" status has been obtained. Dealers must present a copy of their Federal Firearms License (FFL) with an original signature the day of sale in order to purchase firearms without complete a background check. Purchasers will not be charged extra for the Criminal Background Check to be completed. There will be no surcharge or fee (other than shipping fees) for firearms to be shipped to an FFL in another state. If any firearm is shipped to another FFL holder for transfer, all shipping charges, materials and labor will be charged to the buyer. Purchase of a handgun requires that the buyer present a valid NY State pistol permit and a valid pistol coupon must be exchanged in order to obtain the gun.

If a purchaser is unable to receive a firearm due to a "Denied" status following the Criminal Background Check (or for any other reason), the firearm will be resold in this auction, as we have an obligation to pay the consignor regardless of the status of the purchaser. It is illegal for individuals to purchase firearms for someone else. A purchaser must be of legal age, purchase the firearm for him or herself, pass the background check him or herself, and present the required documentation for him or herself.

ID Requirements: Purchasers of firearms must meet both federal and state requirements. A photocopy of your driver's license as well as other documents used to meet the ID requirements will be made and kept with your records for your transaction:

Purchaser must provide a government issued photo ID with name, residence address (not PO Box) and date of birth. If the photo ID provides a PO Box, then a combination of government-issued documents may be provided to satisfy the above requirement. The ID must provide the purchaser's name, gender and date of birth. The issue of the photo ID must be 30 days (or more) prior to the transfer of the firearm.
Handgun purchasers must present their original New York State pistol permit.
If Bontrager Real Estate & Auction Service staff are uncertain as to whether or not the presented documentation meets the requirement set above, the transfer of the firearm will be delayed until the New York State Police and/or the ATF can be contacted for clarification.

Payment and Terms: All firearms must be paid for in full by the close of the auction. Acceptable forms of payment are cash, cashier's check or money order, personal/business check with valid ID, Visa or MasterCard. A 13% buyer's premium and 8% NY state sales tax is charged with each purchase. Buyers who pay with cash or check will receive a 3% discount on the buyer's premium. Sales tax exempt buyers must present valid and current tax exempt paperwork at the time of registration. Tax exempt numbers are routinely checked by the auction company and you will be required to pay sales tax if your paperwork is incomplete or your information is not cleared by the state.

Absentee Bids: Absentee bids are accepted and must be received by 6 p.m. Friday, September 13th by calling 585-343-4529, or by clicking the "Customer Info" tab on our website. When you leave your bid, you must provide your name (as it appears on your driver's license), phone number, and the picture numbers from www.bontragerauction.com and corresponding bid amounts. You may be required to provide additional ID information if you are not a current customer with this auction company. Absentee bidders will also be required to comply with all state and federal laws regarding firearm purchases, including the completion of ATF form 4473 and Criminal Background Check. All absentee bids are executed competitively.

-All sales are final. Everything is sold "AS IS" with no guarantees unless otherwise stated by the auctioneer. It is the responsibility of the bidder to assure him or herself as to the condition of items prior to bidding. Condition reports given by the staff of Bontrager's Auction Service are subjective, and while we strive to be honest, we will not be held responsible or liable for any errors in description. Buyer is responsible for examining items before bidding. Auction company does not take responsibility for buyer's failure to examine. Merchandise is not subject to adjustments once the item has been sold.
-Bontrager Real Estate & Auction Service and its staff will not be held responsible or liable for any errors in absentee/left bids or phone bids, nor for the possible failure to execute left bids for any reason.
-Payment is due in full within the time limits posted in the auction. For this auction, all payment will be made through the credit card you provide when you register. We accept Visa, MasterCard or Discover. (Please note that while you may be able to register for our auction with any credit card, we will only accept Visa, MasterCard, or Discover for payment.) 13% buyer's premium and NYS sales tax added to all items purchased. Late payment will result in a $25 late fee.
-By bidding with our auction you are entering into a contract with our terms and conditions. You are accepting responsibility to perform your duties as winning bidder, and agreeing that Bontrager Real Estate & Auction Service, its employees, officers, owners, representatives, agents, and consignors will not be held liable for any losses, claims, liabilities, judgments, expenses, fees, or other damages arising from the use of our services, website, auction property, and this site, including property damage, injuries, dispute with another bidder, or breach by bidder of this site. Any liability to a purchaser will not exceed the purchase price actually paid.
-Successful bidders will sign their receipt at the time of merchandise pick up indicating that all items are present and in satisfactory condition. No returns, refunds or exchanges will be issued after the merchandise leaves the pick up location.
-Bontrager Real Estate & Auction Service will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. By bidding with our company you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.
-Bontrager Real Estate & Auctio Service has the right to void any sale, suspend bidding, re-sell any item/lots for any other reason.
-All sales are subject to appropriate sales tax and buyer's premium. Buyer's premium is 13% of purchase price and is subject to sales tax.
-Bids cannot be retracted once the auction begins.
-Buyers are responsible for making arrangement to pay for and pick up items within the time frames listed for the auction. Any variation, resulting in late pick up or payment will result in additional fees of at least $25. There is no delivery for this auction. Bontrager's Auction Service is not liable for any damage to property left on the auction premises after the auction, whether or not payment has been made. We reserve the right to impose a storage fee of $10 per month for property not picked up within stated deadlines. Merchandise left 1 month after the auction is subject to sale with the proceeds covering storage and auction fees due to the auction company.
-In the event of legal proceedings arising from this contract or from the auction in connection therewith, buyer consents to being subject to the personal jurisdiction of the courts of the State of New York, Genesee County.

Please note: ABSENTEE BIDDING AND INTERNET PRE-BIDDING will take place Saturday, September 7th through Friday, September 13th. All absentee bidding will take place online. There will be no webcast bidding during the live auction. All internet bidding will end at 4 p.m. on Friday, September 13th. Winning internet bids will be taken to the live auction on Saturday, September 14th and treated as absentee bids. Winning an internet bid does not guarantee that your bid will still be successful at the live auction. Once the live auction has completed, interent bidders who remain successful will be notified by phone or email.

There is a live preview on Friday, Sept. 13th from 4-6 p.m., during which absentee bids can be accepted.

Bontrager's September Sportsman's & Hunting Auction This auction features a large collection of hunting equipment, firearms, and knives. Live Auction: Saturday, September 14th at 9:00 a.m. at Bontrager's Auction Center, 8975 Wortendyke Rd., Batavia, NY 14020 Online Pre-Bidding from Saturday, September 7th through Friday, September 13th at 4 p.m. All bidding will close at 4 p.m. Successful internet pre-bids will be brought to the live auction on Saturday, Sept. 14th, and treated as absentee bids. Winning an online pre-bids does not guarantee that you have won the bid in the live auction. You will be notified via email or phone call following the live auction if your bid is still successful after the live auction. Live Preview: Friday, September 13th: 4-6 p.m. at Bontrager's Auction Center. Bidders who attend the live auction on Saturday, September 14th, and who bid on firearms, will be required to produce driver's license ID, plus pistol permit (required for handgun purchase) and pass a NICS 4473 background check. Background checks will be completed on the premises during the live auction. Our auction company does background checks for black powder rifles. Successful Online Bidders will have credit cards billed at the close of the auction. (Pre-bids will be brought to the live auction on Saturday, Sept. 14th, and treated as absentee bids. Winning pre-bids do not guarantee that you have won the bid in the live auction. You will be notified via email or phone call following the live auction if your bid is still successful after the live auction.) Online firearms purchasers must pass a NICS 4473 background check on Monday, September 16th, 6-8 p.m.. All merchandise bought online must be picked up or shipping arrangements made before Monday, September 23rd.
