A 5% Buyer's Premium will be added to the final bid amount to determine the Final Selling Price. The Buyer's Premium will be reflected in all closing documents by way of Final Selling Price Amount.
SOFT CLOSE
Bidding is set to begin closing at 6pm on August 15, 2019. Any bids accepted within the final 5 minutes of the auction, will extend bidding an additional 5 minutes. Extensions may continue until no bids are accepted for 5 minutes after the previous bid. Bidding is not concluded until 5 minutes between bids, after 6pm has occured. CONDITIONS OF SALE
The property is being sold AS-IS, WHERE-IS without contingencies. The sellers of this Real Estate, and Leist Auctioneers do not represent warranties, whether expressed or implied as related to merchantability, condition, usability, fitness for occupancy, or fitness for a particular purpose, or any matter whatsoever type or nature. All inspections and determinations are the responsibility of hte purchaser. Any improvements which may need to be done will be the responsibility of the purchaser. The seller's offer no statements of representation as they did not own the property prior to Robert's death, and are not familiar with any attributes whether enhancing or detracting. INSPECTIONS
Bidders shall rely entirely upon their own information, judgement, and inspection of the property and records. Bidders have been presented opportunities to inspect prior to auction, and were encouraged to do so. Any inspections conducted Post-Auction shall not produce contingencies related to the sale and closing, nor contingencies related to your bidding. Leist Auctioneers cannot provide inspection or access to the property after the auction, until closing.
WAIVER OF 9 DAY WITHDRAWAL
Bidders understand and acknowledge that by purchasing at auction they thereby waive all rights to the 9 Day Withdrawal Period from date of the Buy/Sell Agreement.
EARNEST MONEY DEPOSIT
In the event that a final tendered bid is accepted as the high bid for this auction, the winning bidder is responsible for an Earnest Money Deposit in the amount of $5,000. This deposit is due immediately concluding the auction via credit card charge. It is agreed that this deposit may be forfeited if the purchaser/bidder is unable to perform closing within 30 days of August 15, 2019. The deposit and sale of the property is not contingent upon financing, post-auction inspection, acceptable environmental reports, surveys, use requirements, other property sales/purchases, or any other matter whatsoever. It is further warranted that any form of payment tendered at the conclusion of the auction is guaranteed, and non-refundable.
CLOSING
The remainder of the purchase price will be due within 30 days from August 15, 2019, or within 10 days of all closing paperwork being ready, whichever is later. If the closing of sale is delayed for reasons related to title work or title defect which may be readily corrected, the closing can be extended for 60 days to correct defects. Closing will be performed by Talon Title Company of Petoskey, MI. A Commitment to Insure has been provided by the Seller through Talon Title Company. Seller will provide at their cost, a deed to the property and an Owners Title Insurance Policy. All other closing costs will be divided equally between Buyer and Seller. Property Taxes which are due on the property on or before the date of the auction will be paid by the Seller, without proration. All Property Taxes due after the date of the auction will be the responsibility of the Buyer without proration.
