BY REGISTERING, ACCEPTING, AND RECEIVING A BIDDING NUMBER, YOU THE BUYER AGREE:
1: The successful Bidder of any Lot or group of lots will pay a BUYER'S PREMIUM, being the percentage as announced added to the winning bid price to arrive at the Final Price.
2: All items are sold "AS IS, WHERE IS" with all faults known and unknown. You are strongly encouraged to inspect the merchandise in person or buy without inspection waiving the right of inspection.
3: ALL SALES ARE FINAL!
4: By Law the public and bidders must be allowed the opportunity to physically inspect all items, and lots being offered at Live and/or Online Sale at the time announced. Due to conditions public inspection may create the Auction Company cannot guarantee or warrant that any original depiction of Lots will contain the same items and/or be in the same condition as originally depicted. Therefore, the Auction Company is not responsible for any items that are missing or damaged after the Lot illustration was created. We will do all possible to insure the original lots or items are not displaced, missing, or damaged.
5: It is the Buyer's responsibility to remove all items purchased using their bidding number the day indicated in advertising or as announced, or to make agreeable arrangements with the Auction Company and/or Sellers to have the items purchased moved as soon as mutually agreeable. There may be a charge for premises storage after the day of sale. If no arrangements are made, or if arrangements made are not honored, the Auction Company will consider the items as abandoned and may resell or otherwise dispose of them.
6: Announcements and notices of the Auction Company take precedence over all prior advertising or any kind. The terms, conditions, advertising, and items of this Auction are subject to change without notice.
7: All sales are for cash, cashier's check, pre-approved check, or PayPal invoice as agreed your registration as evidenced by the issuance of a bidding number.
8: The Auctioneer reserves the right to stop an Auction, change the type of the Auction, reject any and all bids, remove items, add items, or change terms or items at any time during the Auction. If there are questions, immediately contact the Auctioneer for clarification.
9: You are entirely responsible for all items bought using the bidding number issued under your registration with this Auction. When you purchase one or more item you are obligating yourself to pay for all items purchased using your bidding number. You cannot remove any item, or items until payment is made and received, and you have been issued a PAID invoice, receipt, or ticket.
10: Woodmont Auctions, its Auctioneers, and all personnel are in fact Agents for the Seller, only, and do not and cannot warrant the quality, quantity, age, or condition of any item, or articles, in the Auction Sale - again you are buying "AS IS, WHERE IS." Personal inspection is strongly encouraged on the date and time provided or bid waiving inspection!
11: The Auctioneer reserves the right to sell in lots, to the best advantage of the Seller.
12: The Auctioneer reserves the right to control the size of the bids for clarity.
13: In the event of a tied bid or disputed bid, the Auctioneer's word shall be final on whether to reopen the bidding. Be sure to clarify and settle all disputes at the time of the sale. If any dispute arises after the Auction Sale, our sale record is conclusive.
14: When the Auctioneer sells any item, the purchaser assumes ALL RISK AND RESPONSIBILITY for the lot and/or item from the moment the Auctioneer indicates the sale. No swapping permitted - you pay for what you buy using your bidding number.
15: If necessary, the Auction Company may reserve up to three business days to accurately confirm all sales and to issue invoices.
16: THE AUCTION COMPANY DOES NOT MOVE, INSURE, OR SHIP ANY ITEMS PURCHASED.
17: We appreciate your attendance and participation. Having read all the rules of this Auction Sale, if for any reason, you cannot or will not comply with these rules, do not bid. You are welcome to stay, if in person, and observe. However, we must insist on strict compliance in every matter. Our aim is to have a fair, honest Auction Sale for both the Seller and the Buyer. If you have any questions before or during the Auction Sale, please do not hesitate to contact the Auctioneer.
18: If necessary, please allow up to three business day for the Auction Company to accurately confirm all sales.
19: Finally, A SPECIAL NOTICE TO BUYERS - IN ACCEPTING THIS BIDDING NUMBER, you, the Buyer, agree to the provisions of TCA 62-19-124, a Tennessee Act allowing Auctioneers awards of Court costs and Attorney's fee in collections for Auctioneers.
