These terms and conditions are absolute and cannot be altered in any way. If you do not understand any of these conditions, please contact Wester Auction BEFORE bidding. Once you place a winning bid you have entered into a legally binding contract.

Everything is sold "AS IS, WHERE IS" without guarantees of any kind. If you bid without inspecting the item(s), then you accept FULL RESPONSIBILITY for the condition and completeness of the item(s).

The seller reserves the right to accept or reject any and all bids. There has not been a "reserve price" set on the assets, but the seller will not accept a final bid that is deemed to be excessively too low.

Due to varying Internet speeds, browser controls, wireless signals, and other communication problems we DO NOT GUARANTEE that your bid will be accepted on any item. Do not wait until the last possible second to place a bid. If an item is not on your invoice, then your bid was not the last and highest bid recorded and there is no recourse.

Any item(s) that are not paid for AND removed during the Stated Removal Period will be subject to resell with no refund to the original buyer. In addition, your bidding privileges in future auctions may be suspended or revoked.

While descriptions and counts are believed to be accurate, they are NOT GUARANTEED. Buyers need to rely solely upon their own inspection and information. Please make an appointment to preview the equipment.

The buyers hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the sale or during the removal of the items purchased. Buyers remove purchases at their own risk. Buyer's should arrange for professional de-installation of wired, plumbed or built-in items. Many pieces of equipment have potential hazards and should be de-installed and moved by professionals with proper equipment.

Absolutely no adjustments, claims or refunds will be allowed after the item(s) are removed from the auction site. ANY CLAIMS MUST BE MADE WHILE THE ITEMS ARE ON THE AUCTION PREMISES. In no event will auctioneer's or seller's liability to buyer ever exceed the purchase price paid.

Arrangements for the removal (or shipment) of purchased items is the sole responsibility of the buyer pursuant to and as part of the contract of sale. Buyers should bring their own moving equipment and labor.

The final total due for the buyer's purchases will include a 10% Buyer's Premium.

THIS IS AN ONLINE BIDDING AUCTION. THERE WILL BE NO LIVE AUCTION ON THE PREMISES. This is a COMPLETE operational bumper car business being sold as a package.
