**All items are sold AS IS, WHERE IS with NO WARRANTY or GUARANTEE.

**All bids are based on the inspection, evaluation, and desire of the bidder(s).
**In the event, any item is lost, or stolen, before it is removed from the auction site, the buyer will be limited to a refund of the purchase price. The seller and/or auctioneer will not be liable for more than the purchase price of any item.

PAYMENT: Full payment is due immediately after the auction. The credit card given at the time of registration will be used for the full payment of your invoice (IMMEDIATELY AFTER BIDDING CONCLUDES).

If your credit card is declined for ANY REASON, you will have until 12:00 NOON on the day after the auction ends to make full restitution, with another credit card. If you fail to pay your invoice IN FULL within the time allotted, Wester Auction reserves the right to sell the items on your invoice.

In addition, you will be removed from our approved bidders list for future auctions.

REMOVAL: Removal will be on Thursday, January 25 from 10 AM until 6PM. After Thursday, removal is by appointment only with Brian Amstead (919) 819-6614. EVERYTHING HAS TO BE OUT OF THE BUILDING BY SATURDAY, JANUARY, 26.


Failure by the buyer(s) to meet the removal schedule and conditions may result in the loss of your purchases, without refund.
The buyer is to provide all manpower, tools, and equipment needed to remove the items from the facility. In the case of a large built-in item (walk in cooler, etc.) the buyer may be required to hire a professional removal company, that is fully qualified and insured.

The seller will have one person on site to insure that you have access and do not damage the building. This person will not be responsible for watching your items or assisting you with loading.

SELLING MULTIPLE LIKE ITEMS: if we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.)

CREDIT CARD CHARGEBACKS:
**Each Bidder agrees not to initiate a credit card chargeback with respect to any charges.
**Each Bidder further agrees that initiating a credit card chargeback is a DIRECT VIOLATION of the Terms and Conditions agreed upon by the bidder when registering to bid.
**With the Auctioneer's presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which the disputed charges were made, the bidder authorizes such bank, credit card company, or other financial institution to deny any credit card chargeback and to re-credit all amounts to the account of the Auctioneer.

SOMEONE HAS MADE AN OFFER TO PURCHASE EVERYTHING AND THE OWNER HAS ACCEPTED. THE MONEY HAS CHANGED HANDS, AND THEREFORE WE MUST STOP THE AUCTION. WE ARE VERY SORRY FOR THIS, BUT WE MUST ABIDE BY THE WISHES OF OWNER. IF YOU NEED OVENS, WE HAV A VERY NICE SET OF MIDDLEBY MARSHAL OVENS IN OUR WAREHOUSE.
