CONDITION:
**All items are sold AS IS, WHERE IS with NO WARRANTY or GUARANTEE.
**All sales are final.
**All bids are based on the inspection, evaluation, and desire of the bidder(s).
**In the event, any item is lost, damaged, or stolen, before it is removed from the auction site, the buyer will be limited to a refund of the purchase price. The seller and/or auctioneer will not be liable for more than the purchase price of any item.

PREVIEW: You may preview the items in this auction on Sunday, October 29 from 1:00 PM until 5:00 PM.

PAYMENT: Full payment is due immediately after the auction. The credit card given at the time of registration will be used for the full payment of your invoice (IMMEDIATELY AFTER BIDDING CONCLUDES).

If your credit card is declined for ANY REASON, you will have until 12:00 NOON on October 30 to make full restitution, with another credit card. If you fail to pay your invoice IN FULL within the time allotted, Wester Auction reserves the right to sell the items on your invoice.

In addition, you will be removed from our approved bidders list for future auctions.

REMOVAL: Monday and Tuesday, October 30 & 31 from 10:00 AM until 5:00 PM. EVERYTHING HAS TO BE REMOVED BY TUESDAY, OCTOBER 31.

Failure by the buyer(s) to meet the removal schedule and conditions may result in the loss of your purchases, without refund.
The buyer is to provide all manpower, tools, and equipment needed to remove the items from the facility. In the case of a large built-in item (walk in cooler, etc.) the buyer may be required to hire a professional removal company, that is fully qualified and insured.

The auction company will have one person on site to insure that you have access and do not damage the building. This person will not be responsible for watching your items or assisting you with loading.

SELLING MULTIPLE LIKE ITEMS: if we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.)

CREDIT CARD CHARGEBACKS:
**Each Bidder agrees not to initiate a credit card chargeback with respect to any charges.
**Each Bidder further agrees that initiating a credit card chargeback is a DIRECT VIOLATION of the Terms and Conditions agreed upon by the bidder when registering to bid.
**With the Auctioneer's presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which the disputed charges were made, the bidder authorizes such bank, credit card company, or other financial institution to deny any credit card chargeback and to re-credit all amounts to the account of the Auctioneer.

The owner of Mainsail has reached an impass with the building owner over the new lease and has decided to retire instead. Everything has to be out of the building by Tuesday, October 31 so this is a very short notice sale.
