EQUIPMENT CONDITION:
**All items are sold AS IS, WHERE IS with NO WARRANTY or GUARANTEE.
**All sales are final.
**All bids are based on the inspection, evaluation, and desire of the bidder(s).
**In the event, any item is lost, damaged, or stolen, before the invoice is settled, the sale will be voided and the buyer not charged. Once the invoice has been settled the item(s) become THE SOLE RESPONSIBILITY OF THE BUYER.

PREVIEW: You may visit the site to perview the equipment, but you are NOT to hinder the customers of the operations in progress. You must wit until the customers have been served before asking questions or viewing the equipment.
PAYMENT: Full payment is due immediately after the auction. The credit card given at the time of registration will be used for the full payment of your invoice (IMMEDIATELY AFTER BIDDING CONCLUDES), unless you have made PRIOR arrangements with Wester Auction for an alternate form of payment.

If your credit card is declined for ANY REASON, you will have 12 hours to make full restitution, with another credit card. If you fail to pay your invoice IN FULL within the first 12 hours, Wester Auction reserves the right to sell the items on your invoice. In addition, you will be removed from our approved bidders list for future auctions.

REMOVAL: The removal period will be by Crbtree Valley Mall management and will most likely have to occure BREFORE THE MALL OPENS or AFTER THE MALL CLOSES. The exact removal hours will be posted on your invoice. Failure by the buyer(s) to meet the removal schedule and conditions may result in the loss of your purchases, without refund.
The buyer is to provide all manpower, tools, and equipment needed to remove the items from the facility.

SELLING MULTIPLE LIKE ITEMS: if we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.)

SALES TAX: The State of NC does not require us to collect sales tax on the items sold in this auction.

CREDIT CARD CHARGEBACKS:
**Each Bidder agrees not to initiate a credit card chargeback with respect to any charges.
**Each Bidder further agrees that initiating a credit card chargeback is a DIRECT VIOLATION of the Terms and Conditions agreed upon by the bidder when registering to bid.
**With the Auctioneer's presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which the disputed charges were made, the bidder authorizes such bank, credit card company, or other financial institution to deny any credit card chargeback and to re-credit all amounts to the account of the Auctioneer.

You have the opportunity to buy some fantastic equipment in this auction. The current owner bought the business less than a year ago, completely remodeled the lobby, and then could not find qualified workers to help him run the business. He owns another successful food service establishment 60+ miles way and cannot operate both locations. Many of the items in this auction were purchased NEW within the past 12 months. Everything else in the store was purchased new within the past 5-6 years. The business will remain open until the bidding concludes. You may visit the site to preview the equipment, but you are NOT to hinder the customers or the operations in progress. You must wait until the customers have been served before asking questions or viewing the equipment.
