CONDITION:
**All items are sold AS IS, WHERE IS with NO WARRANTY or GUARANTEE.
**All sales are final.
**All bids are based on the inspection, evaluation, and desire of the bidder(s).
**In the event, any item is lost, damaged, or stolen, before the invoice is settled, the sale will be voided and the buyer not charged. Once the invoice has been settled the item(s) become THE SOLE RESPONSIBILITY OF THE BUYER.

PAYMENT: Full payment is due immediately after the auction. The credit card given at the time of registration will be used for the full payment of your invoice (IMMEDIATELY AFTER BIDDING CONCLUDES), unless you have made PRIOR arrangements with Wester Auction for an alternate form of payment.

If your credit card is declined for ANY REASON, you will have 12 hours to make full restitution, with another credit card. If you fail to pay your invoice IN FULL within the first 12 hours, Wester Auction reserves the right to sell the items on your invoice. In addition, you will be removed from our approved bidders list for future auctions.

REMOVAL: The removal period will be Saturday, March 18 for 2 hours after the bidding concludes, and on Sunday, March 19 from 10:00 AM until 5:00 PM. After March 19, access to the building will be by appointment only by calling 984-500-9395 or 919-522-9802. Failure by the buyer(s) to meet the removal schedule and conditions may result in the loss of your purchases, without refund.
The buyer is to provide all manpower, tools, and equipment needed to remove the items from the facility. In the case of a large built-in item (hood system, walk in cooler, etc.) the buyer may be required to hire a professional removal company, that is fully qualified and insured.

SELLING MULTIPLE LIKE ITEMS: if we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.)

SALES TAX: The State of NC does not require us to collect sales tax on the items sold in this auction.

CREDIT CARD CHARGEBACKS:
**Each Bidder agrees not to initiate a credit card chargeback with respect to any charges.
**Each Bidder further agrees that initiating a credit card chargeback is a DIRECT VIOLATION of the Terms and Conditions agreed upon by the bidder when registering to bid.
**With the Auctioneer's presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which the disputed charges were made, the bidder authorizes such bank, credit card company, or other financial institution to deny any credit card chargeback and to re-credit all amounts to the account of the Auctioneer.

This will be an online auction ONLY. All bidding will be done online, with no live bidding on the day of the auction at the restaurant. HOWEVER, we will have someone at the auction site one hour before the items begin to sell, that can show you how to bid online, or can bid for you on the computer. You may show up at the site, preview the items, and place bids with the company representative. These bids will be processed in the normal way for your benefit. You may stay and watch the proceedings, and gain information about how to bid in the future.
